LIENS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br /> 13A CLAIM OF VISTA PLANTATIONASSOCIATION, INC. <br /> Attorney Polackwich recapped his memorandum providing background on the 661' <br /> Avenue expansion project and the transaction made by the County in 2009 for a drainage <br /> easement and a . 0906 acre parcel of access road . He conveyed that Vista Plantation Association, <br /> Inc . (Association) , was claiming one-half of the amount paid to Vista Properties of Vero Beach, <br /> Inc . (Vista Properties) by the County in 2009 , for a drainage easement, and the entire amount <br /> paid for the . 0906 parcel . The Association was also demanding reimbursement of its legal and <br /> engineering fees . After Attorney Polackwich met with the Title Insurance Company ' s Attorney, <br /> Calvin Brown, they concluded that the Association has a legitimate claim, and found that Vista <br /> Properties was not the owner of the . 0906 acre parcel purchased by the County in 2009 ; the <br /> kW Property Appraiser' s records were incorrect . As to the drainage easement, Vista Properties owns <br /> the golf course and both parties own the lakes where the drainage easement runs . Attorney <br /> Polackwich met with John Kurtz, owner of the Association, and he denied any knowledge of <br /> wrongdoing on his part in 2009 ; however, he offered to donate a small parcel at the corner of SR <br /> 60 and 66h Avenue, which the County needs for the expansion project, and offered to absorb <br /> additional expenses . He recommended the Board accept the various positions and settlements , <br /> and move forward with the 66h Avenue project. <br /> Commissioner Davis suggested staff use a checklist to ensure this type of situation does <br /> not happen in the future . <br /> Attorney Polackwich assured the Board this would not happen again. <br /> 142 Pc 066 <br /> February 14, 2012 15 <br />
