REQUEST FROM STAFF FOR AUTHORIZATION TO INITIATE AN LDR <br />AMENDMENT TO CREATE SPECIAL OVERLAY REGULATIONS FOR THE <br />WEST GIFFORD INDUSTRIAL AND COMMERCE (WGIC) AREA ON 163 <br />ACRES OF PROPERTY IN WEST GIFFORD ZONED IG (GENERAL <br />INDUSTRIAL) <br />Community Development Director Stan Boling recapped his memorandum dated <br />February 3, 2014, providing background, conditions, and analysis pertaining to staff's request for <br />authorization to: (1) update the draft overlay regulations for the West Gifford Industrial and <br />Commerce (WGIC) area (163 acres bordered by 43'h Avenue on the east, 58th Avenue on the <br />west, 45th Street on the north, and 41s Street on the south), which is zoned as General Industrial <br />(IG); and (2) initiate the formal process for adopting the draft regulations. He recommended the <br />Board authorize staff to initiate a Land Development Regulation (LDR) Amendment for the <br />WGIC overlay regulations (as opposed to a rezoning approach), invoke the pending ordinance <br />doctrine, and direct staff to apply the draft regulations in the interim. <br />A lengthy discussion ensued as Commissioners posed questions to staff and expressed <br />opinions on the soundness of the pending ordinance doctrine; the criteria proposed for the three <br />special exception uses (batch plants, mulch operations, and demolition debris facilities) in West <br />Gifford's IG zoned property; the requirements for IG and Light Industrial (IL) zoning; and <br />grandfathering uses. <br />February 18, 2014 13 <br />
