Attorney Polackwich recommended having the extensions approved by Resolution <br />following a public hearing. <br />MOTION WAS AMENDED by Commissioner Flescher, <br />SECONDED by Chairman Wheeler, to authorize the <br />Board to extend the six-year impact fee refund period for <br />any impact fee category or categories for an additional <br />three (3) years, by Resolution following a public hearing <br />and applying only to those impact fees for which the six- <br />year period has not yet expired. <br />The Chairman CALLED THE QUESTION, and by a 4-1 <br />vote (Vice Chairman O'Bryan opposed), the Motion <br />carried. The Board adopted Ordinance 2012-004, <br />AMENDED to apply Section 3 Subsection (2)(h) to <br />impact fee payments commencing subsequent to adoption <br />of this Ordinance, and not retroactively; and to delete <br />Section 3 Subsections (2)(h)(ii); (2)(h)(in); and (2)(h)(iv); <br />and to extend the six-year impact fee refund period for any <br />impact fee category or categories for an additional three <br />(3) years, by Resolution following a public hearing and <br />applying only to those impact fees for which the six-year <br />period has not yet expired, amending Section 1000.15 of <br />the Code of Indian River County; establishing a procedure <br />for refunding certain impact fees which are not <br />encumbered or spent within specified time periods; <br />establishing authority to extend the time period within <br />which certain impact fees must be encumbered or spent; <br />March 13, 2012 17 <br />BK 142PG193 <br />
