He requested that the Board use some type of <br /> governing authority to opt out of the State Statute, and keep guns out of the parks . <br /> Attorney Polackwich, responding to Commissioner Davis ' s inquiry, confirmed that <br /> penalties or sanctions may be imposed on Counties that have Ordinances knowingly contrary to <br /> State law. He explained that the County does not have the choice of opting out and not <br /> following State law. <br /> There being no further speakers, the Chairman closed the Public Hearing, <br /> MOTION WAS MADE by Vice Chairman Wheeler, <br /> SECONDED by Commissioner Davis , to approve staff' s <br /> recommendation. <br /> Commissioner O ' Bryan acknowledged the points made by Messrs . Tripson and Oberlin, <br /> but pointed out that it was inappropriate for the County Commission to be in violation of State <br /> law.
