permit to carry in a park or recreational area, the proposed Ordinance would make the County ' s <br /> Ordinance consistent with State law. <br /> The Chairman opened the Public Hearing. <br /> Jens Tripson , 2525 14th Street, after learning from Attorney Polackwich that County <br /> Code needs to conform with State law on this matter, voiced discomfort about people in County <br /> parks being allowed to carry guns . <br /> Scott Oberlin , 644 536 Lane, opposed the proposed Ordinance , stressing that life- <br /> threatening situations could happen as a result of people bringing concealed weapons into public <br /> places , including local government offices . He requested that the Board use some type of <br /> governing authority to opt out of the State Statute, and keep guns out of the parks . <br /> Attorney Polackwich, responding to Commissioner Davis ' s inquiry, confirmed that <br /> penalties or sanctions may be imposed on Counties that have Ordinances knowingly contrary to <br /> State law. He explained that the County does not have the choice of opting out and not <br /> following State law. <br /> There being no further speakers, the Chairman closed the Public Hearing, <br /> MOTION WAS MADE by Vice Chairman Wheeler, <br /> SECONDED by Commissioner Davis , to approve staff' s <br /> recommendation. <br /> Commissioner O ' Bryan acknowledged the points made by Messrs . Tripson and Oberlin, <br /> but pointed out that it was inappropriate for the County Commission to be in violation of State <br /> law. He felt the County ' s hands were tied, and suggested that the proper course would be to <br /> address the Legislature about amending the Statute . <br /> March 22 , 2011 15 <br />
