his property, which is located at 5955 41St Street, abutting the Sylvan Lakes subdivision <br />. <br /> Recapping the background history on this situation, he stressed that because of the lack of a <br /> drainage easement or swale on the Sylvan Lakes properties , his entire acreage floods and <br /> becomes swampland during rain events . <br /> Public Works Director Christopher Mora, with input from Community Development <br /> Director Robert Keating, provided background history on when Sylvan Lakes was first platted in <br /> 1989, at which time a drainage easement was recorded, but never dug as a ditch. However, he <br /> stated that Code Enforcement at the time did not follow up, and issued the Certificates of <br /> Occupancy without the drainage swales being constructed . <br /> Commissioner Davis supported Mr. Spruce ' s right to not have his property flooded, and <br /> wondered if a solution could be found that would be acceptable to all parties . <br /> MOTION WAS MADE by Commissioner Davis, <br /> SECONDED by Chairman Solari , to have staff enter into <br /> negotiations with Dennis Spruce and the Sylvan Lakes <br /> Homeowners Association, to seek a resolution acceptable <br /> to all parties, with regards to the drainage problem <br /> occurring on property located at 5955 41St Street, and <br /> owned by Mr. Spruce , <br /> Roland DeBlois , Chief of Environmental Planning and Code Enforcement, relayed that <br /> prior mediation attempts between staff and the Sylvan Lakes Property Owners Association <br /> ( Sylvan Lakes) had been unsuccessful . <br /> Attorney Polackwich conveyed that there were two possible remedies : ( 1 ) to have Code <br /> Enforcement try to enforce County code on houses that were approved years ago ; or (2 ) for Mr . <br /> Spruce to pursue a private remedy, through the judicial system, between himself and Sylvan <br /> Lakes . <br /> April 12 , 2011 14 <br />
