8. G. SECTOR 3 BEACH AND DUNE RESTORATION PROJECT CHANGE ORDER #6 <br />CONTRACT COST REDUCTION RANGER CONSTRUCTION INDUSTRIES, <br />INC. <br />Pubhc Works Director Chris Mora provided background regarding the Sector 3 Beach <br />and Dune Restoration project, explained the details of Change Order No. 6, and responded to <br />Commissioner Flescher's questions and concerns over the issue that some of the subcontractors <br />had not received their fuel cost adjustments. <br />Coastal Engineer James Gray, Jr. reported that Ranger Construction Industries, Inc. <br />(Ranger) had submitted their final payment request for release of retainage and approximately <br />$450,000 would be retained until the issue can be brought before the Board for resolution. <br />Director Mora pointed out a provision in the contract where prior to releasing the <br />remaining funds for payment, staff requires a Release of Lien, which shows that all sub- <br />contractors have been paid, and once this is received from all the subcontractors, staff will <br />release the final payment. He revealed that all the subcontractors involved in the project had <br />submitted their Releases of Lien to staff, with the exception of Henry Fischer and Sons (Fischer), <br />who had been paid for the materials but not the fuel surcharge, which represents about $60,000. <br />Director Mora said that staff would be withholding this dollar amount from the final payment to <br />Ranger until Fischer's Release of Lien is received. <br />County Attorney Alan S. Polackwich, Sr. verified that the final payment could be held <br />until the conditions of the contract have been met. He also disclosed that Fischer could make a <br />claim on the payment portion of the Payment and Performance Bond if they so desired. <br />Chuck Kramer, Henry Fischer and Sons, thanked Attorney Polackwich for enforcing the <br />contract. He provided a brief history regarding the fuel cost adjustment that was requested and <br />granted by the Board of County Commissioners on March 15, 2011.
