The Chairfncin opened the Public Hearing . <br /> Robert Cigala , 2035 Ocean Ridge Circle , spoke about the devastating effects of <br /> Oxycontin addiction , and asked the Board to prohibit the pain clinics from dispensing that <br /> particular medication . IIe also urged the Board to close any loopholes opened up by the State <br /> exemption for board - certified or fellowship -trained physicians . <br /> There being no further speakers, the Chairman closed the Public Hearing . <br /> ON MOTION by Commissioner Flescher, SECONDED <br /> by Vice Chairman Wheeler , the Board unanimously <br /> adopted Ordinance 2011 - 004 , creating Chapter 315 of the <br /> Code of Indian River County entitled " The Indian River <br /> County Pain Management Clinic and Controlled <br /> Substances Ordinance " ; regulating and prohibiting certain <br /> activities relating to the operation of pain management <br /> clinics and pharmacies prescribing and dispensing <br /> controlled substances ; and providing for severability , a <br /> general repealer and an effective date . <br /> Commissioner Davis wanted the County Attorney to look into the State ' s exemption and <br /> see whether the County ' s Ordinance can be more restrictive than the State legislation . <br /> ON MOTION by Commissioner Davis , SECONDED by <br /> Chairman Solari , the Board unanimously directed staff to : <br /> ( 1 ) reevaluate the Ordinance in July 2011 and in one year <br /> (May 2012) ; and (2) research whether the County ' s <br /> Ordinance can be more restrictive than the State law . <br /> May 17 , 2011 10 <br />
