120 UTILITIES SER VICES — NONE <br /> 13 . COUNTY ATTORNEY MATTERS <br /> 13.A. RESOLUTIONRELATING TO FLAVORED TOBACCO PRODUCTS <br /> County Attorney Alan S . Polackwich, Sr . relayed the request of the Substance Awareness <br /> Council ( SAC) for the Board to adopt a Resolution encouraging retailers in the County not to sell <br /> flavored tobacco products targeting young people . He reported that he has amended the <br /> proposed Resolution provided by the SAC , and asked the Board to consider adoption of the draft <br /> Resolution . <br /> Chairman Solari felt that the Resolution, which was geared towards education , rather than <br /> regulation, would increase public awareness of the dangers of flavored tobacco products to <br /> youth . <br /> Commissioner Davis viewed the proposed Resolution as overregulation , since the sale of <br /> tobacco products to minors is already illegal . <br /> A brief discussion ensued as Chairman Solari responded to Commissioner Davis ' s <br /> assertion that this matter should have come to the Board under County Attorney matters , rather <br /> than as a Commissioner ' s Item . <br /> Vice Chairman Wheeler agreed with Commissioner Davis that the Resolution is <br /> government overreaching, reiterating that it is already illegal to sell cigarettes to minors . He also <br /> pointed out that he had learned from the Sheriff s Department , tobacco retailers , and School <br /> Resource Officers that regular tobacco use is more prevalent among young people . <br /> May 3 , 2011 18 <br />
