13. 0 ADDITION - RELEASE OF EASEMENT TO KENNETH AND PATRICIA HILL <br /> Deputy County Attorney William DeBraal provided background pertaining to the <br /> County ' s June 2006 Developer Agreement with Vero Villages , LLC , wherein each party would <br /> pave a portion of 37 "' Street, with Vero Villages acquiring the necessary right- of-way and utility <br /> easements . He reported that certain property owners along the north side of 37t" Street between <br /> 58 "' and 66 "' Avenues , including Kenneth and Patricia Hill , had erroneously conveyed an <br /> incorrect amount of property for the right- of--way and utility easements , and the County had <br /> unintentionally accepted them . He said that in order to clear title for the Hills ' scheduled closing <br /> on May 5 , 2011 , the County needs to convey back to them their entire parcel , excluding the 10 - <br /> foot right-of-way strip ; and enact a Release of Easement , except for the 15 -foot utility easement <br /> at the southern tip of the property . He thereafter confirmed staff' s recommendation for the Board <br /> to approve the Corrective Deed and Release of Easement to the Hills , as well as the Resolution <br /> detailing the need for the corrective deed . He added that he had discovered another property <br /> where an incorrect conveyance was made to the County and would require correction . <br /> MOTION WAS MADE by Commissioner Davis , <br /> SECONDED by Commissioner rlescher , to approve <br /> staff' s recommendation . <br /> Attorney Polackwich related that Attorney DeBraal ' s prompt handling of this matter on <br /> very short notice had allowed the Hills to proceed with their closing . <br /> The Chairman CALLED THE QUESTION , and the <br /> Motion carried unanimously . The Board approved : ( 1 ) <br /> Resolution 2011 -0353 correcting right-of- way <br /> conveyances along 37 "' Street between 58 "' and 66"' <br /> Avenues ; and ( 2 ) authorized the Chairman to execute the <br /> corrective deed for Kenneth and Patricia Hill , as <br /> recommended in the memorandum of May 2 , 2011 . <br /> May 3 , 2011 21 <br />
