Attorney Polackwich said that Fellsmere ' s proposed Ordinance provides a concept that <br /> will not work at this time because Fellsmere would not be providing a service and extending it t <br /> outside of their area for the benefit of the residents , they are considering a service which they do <br /> not currently provide , and declaring the area to be their exclusive territory . He believed that g <br /> under the old Statute , the County has an obligation to provide objections to them promptly, <br /> which should be no later than the end of next week . <br /> s <br /> MOTION WAS MADE by Commissioner Solari , <br /> SECONDED by Commissioner Davis to direct : <br /> ( 1 ) Director Brown to attend the Thursday, June 21 , 2012 , <br /> k' <br /> Fellsmere City Council meeting ; (2) Attorney Polackwich r <br /> to write the appropriate letter to include the problems of <br /> exclusivity of the franchise and the possibility of Indian <br /> River County residents being taxed with no representation; <br /> and (3 ) staff to encourage the County and City of <br /> Fellsmere to embrace the operation as a partnership that <br /> would be a win-win for everyone in the County . <br /> Discussion ensued regarding the County and Fellsmere embracing this operation; putting <br /> the natural gas franchise within Fellsmere ' s jurisdiction, not the County ' s ; moving this forward t' <br /> in the spirit of economic development, not economic enhancement for Fellsmere ; and this not <br /> being perceived as an adversarial attack or statement of aggression . <br /> r' <br /> Y <br /> Director Brown voiced staff' s concerns as to whether this would provide service to <br /> people who otherwise would not be able to get service .
