ARTICLE 12 - GRIEVANCE PROCEDURE <br /> Section 1 : A grievance is defined as a dispute involving the interpretation or application <br /> of the provisions of this Agreement, except as exclusions are noted in other Articles of <br /> this Agreement. Any grievance filed shall refer to the provision or provisions of this <br /> Agreement alleged to have been violated. <br /> Section 2 : Employees covered by this bargaining unit shall have the right to use only this <br /> procedure and no right to any other procedure (i. e . , rules and regulations, administrative <br /> policy, etc .) . New employees shall serve a one-year period of probation and shall be <br /> entitled to this procedure, except for as prohibited in Article 13 . <br /> Section 3 : Grievances shall be presented and adjusted in the following manner: <br /> Step 1 — Division Level <br /> An employee having a grievance may, within five days following the first occurrence <br /> giving rise to the grievance, submit the grievance in writing to the EMS Chief, setting <br /> forth specifically the complete facts on which the grievance is based, the specific <br /> provision or provisions of the Agreement allegedly violated, and the remedy <br /> requested. The EMS Chief will meet with the employee, accompanied by the Union, <br /> to discuss the grievance. The EMS Chief shall communicate a decision in writing to <br /> the employee and the Union within five days following discussion of the written <br /> grievance. <br /> $tep 2 — Department Level <br /> If the grievance is not settled at Step 1 , the employee may submit the grievance in <br /> writing to the Department Director within five days after receipt of the decision at <br /> Step 1 . The Department Director will meet with the employee, accompanied by the <br /> Union, to discuss the grievance. The Department Director shall communicate a <br /> decision in writing to the employee and the Union within five days following <br /> discussion of the written grievance . <br /> Step 3 — Administration Level <br /> If the grievance is not settled at Step 2, the employee may submit the grievance in <br /> writing to the County Administrator (or designee) within five days after receipt of the <br /> decision at Step 2 . The County Administrator (or designee) will meet with the <br /> employee, accompanied by the Union, to discuss the grievance. The County <br /> Administrator (or designee) shall communicate a decision in writing to the employee <br /> and the Union within five days following discussion of the written grievance. <br /> 5 <br />
