<br />Act hereinabove mentioned for the calendar year 1954 for aeronautical purposes within this
<br />county, and that the State Comptroller be,, and he is hereby authorized, empowered and
<br />directed to recognize the county's fifty per cent (506) of such funds for the calendar year
<br />1954 as monies expendable by Florida Development Commission for aeronautical purposes as
<br />the agent of this county.

<br />carried, public hearing was ordered on the following Petition of Frank J, Bennett, by and
<br />through his attorneys, Merriman, Boring & Sutherland.

<br />TO: THE COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA:
<br />Comes now the petitioner, Frank J. Bennett, by and through his undersigned
<br />attorneys, Merriman, Boring & Sutherland, and petition this Honorable Board of County
<br />Commissioners of Indian River County, Florida, to close, vacate and abandon those certain
<br />road and street right-of-ways, as found on the plat of Bougainlea Subdivision, filed Sept.
<br />16, 1926, in Plat Book 1, page 97, public records of Indian River County, Florida, in so far
<br />as said street and road right-of-ways apply to 14th and 15th Streets, which run in on east
<br />and west direction, in so far as said rights of way lie between 43rd Avenue and 45th Avenue,
<br />and all of that part of 44th Avenue going in a North and South direction lying between 16th
<br />Street and 14th Street and all that part of 45th Avenue lying between 16th Street and 14th
<br />Street, going in a North and South direction. Petitioner further petitions said Board of
<br />Couhty Commissioners to renounce and disclaim any right of the County and the public in and
<br />to said land delineated on said plat, as a street, road, or highway. Said streets are more
<br />particularly described for the purpose of vacation, as follows:
<br />All that part of 14th Street lying in an East and Best Direction
<br />between 43rd Avenue and 45th Avenue, Bougainlea Subdivision,
<br />according to Plat Book 1, page 97, public records of Indian River
<br />County, Florida.
<br />All that part of 15th Street running in an East and West Direction
<br />lying between 43rd Avenue and 45th Avenue, Bougainlea Subdivision,
<br />according to Plat Book 1, page 979 public records of Indian River
<br />County, Florida.
<br />That part of 44th Avenue running in a North and South direction
<br />between 16th Street and 14th Street, Bougainlea Subdivision,
<br />according to'Plat Book 1, page 97, public records of Indian
<br />River County, Florida.
<br />That part of 45th Avenue, running in a North and South direction
<br />lying between 16th Street and 14th Street, Bougainlea Subdivision,
<br />according to Plat Book 1, page 97, public records of Indian River
<br />County, Florida.
<br />Petitioner further requests that the Honorable Board of County Commissioners
<br />execute a Quit Claim Deed, releasing that certain easement as found on Plat of Bougainlea
<br />Subdivision recorded in Plat Book 1, page 97, public records of Indian River County, Florida,
<br />to the easement -on, in and under the rear five feet of all lots for the location of sewers,
<br />poles, water pipes, drains, telephone, electric cables or ducts in so far as said easement
<br />affects Blocks 2 and 3 of said Subdivisiond
