AGREEMENT 0 <br /> BETWEEN <br /> INDIAN RIVER COUNTY, FLORIDA <br /> AND <br /> LENNAR HOMES, INC . <br /> FOR THE CONSTRUCTION OF OFF-SITE UTILITIES <br /> THIS AGREEMENT by and between INDIAN RIVER COUNTY, a political subdivision of the State of <br /> Florida, the address of which is 1840 25th Street, Vero Beach , Florida 32960 (hereinafter the "COUNTY") <br /> and Lennar Homes , Inc . , the address of which is 1015 North State Road 7 , Suite C , Royal Palm Beach, <br /> Florida 33411 , (hereinafter the DEVELOPER) is effective upon execution by the second of the two parties . <br /> WHEREAS , the DEVELOPER, in conjunction with the construction improvements at Verona Trace <br /> Subdivision and Villas at Verona Trace , is providing water and wastewater facilities to serve the subject <br /> property located between 981h Avenue and 102"d Avenue, and 8th Street and 12 Street, and more specifically <br /> described in Exhibit "A" and <br /> WHEREAS , pursuant to Section 201 . 11 , The Code of Indian River COUNTY , the COUNTY , requires <br /> the DEVELOPER to provide the utility improvements to serve the regional area, and agrees to reimburse the <br /> DEVELOPER, as provided herein , for the cost of providing these off- site utilities , <br /> NOW , THEREFORE , for and in consideration of the mutual promises set forth herein and other good and <br /> valuable consideration , the COUNTY and DEVELOPER agree as follows : <br /> 1 . Off- Site Utilities : <br /> The DEVELOPER shall construct the off- site utilities described herein in accordance with the technical <br /> specifications provided by the COUNTY attached hereto as Exhibit "A" ("Technical Specifications") : <br /> A . Increase the On- site pump station capacity from a size capable of servicing the proposed development <br /> to one with the ability to handle off- site peak flows of an additional IMGD with associated piping <br /> and appurtenances to allow for the utilization of the station as a regional pump station on an as <br /> needed basis . <br /> B . Increase the proposed 8 " water main required to service the development to a 12 " water main in <br /> accordance with Indian River County Utility Departments goal to insure future master plan lines <br /> within the 981h avenue corridor are of sufficient capacity to service future development. The <br /> proposed construction will consist of extending the existing 12 " Water Main at the intersection of <br /> 16`h Street and 98 `h Avenue south to the intersection of 81h Street and 98 `h Avenue including all <br /> necessary mains , valves , and associated appurtenances . <br /> A sketch of the proposed improvements including detailed estimates of the construction quantities <br /> are included in Appendix ' s B and C of this agreement. <br /> 2 . Reimbursement : <br /> The COUNTY shall reimburse the DEVELOPER based on an itemized invoice of the installed <br /> Pagel of 8 <br /> 6 .
