h <br /> AGREEMENT FOR THE CONTRIBUTION OF FUNDS <br /> FOR ROSELAND ROAD LEFT-TURN LANE <br /> JO J J - <br /> THIS AGREEMENT , made and entered into this 1 st day of May <br /> 2007 by and between BY THE RIVER, INC . , a Florida nonprofit corporation , hereinafter <br /> referred to as " Developer", and INDIAN RIVER COUNTY, a political subdivision of the <br /> State of Florida , hereinafter referred to as "County". <br /> WITNESSETH : <br /> 1 . Developer received conceptual approval by the Board of County <br /> Commissioners on February 18 , 2003 for the project identified as : <br /> Project Title: Kashi Ashram PD ACLF Pod K <br /> Project Number: PD-07-05-04 <br /> Project Live- IRC Number: 201070204-57823 <br /> Project Location : 11145 Roseland Road , Roseland , FL 32957 <br /> 2 . Developer is required to construct a left-turn lane on Roseland Road <br /> according to County standards . <br /> 3 . Developer acknowledges that County has the Roseland Road <br /> Rehabilitation Project currently underway and it is acceptable to County to include the <br /> construction of the left-turn lane into County's road project. <br /> 4 . It is agreed between the parties that in consideration of the <br /> contribution by Developer to County of the sum of $ 103 , 801 .06, which sum represents the <br /> cost of construction of the left-turn lane along Roseland Road , County releases Developer <br /> from the condition to construct said left-turn lane . <br /> 5. Developer acknowledges that the payment of the sum referenced in <br /> paragraph 4 above is to be deposited into the Roseland Road Rehabilitation Project Account <br /> ( 109038-369940-07803) of the County, and Developer is not entitled to any refund or return <br /> of monies associated with this agreement. <br /> IN WITNESS WHEREOF, the parties hereunto set their hands and seals this <br /> 1 st day of May 2007. <br /> BY THE RIVER, INC . , a Florida nonprofit <br /> corporation <br /> By <br /> D"urga D.
