r <br /> AGREEMENT <br /> BETWEEN 1718887 <br /> THIS DOCUMENT HAS BEEN RECORDED <br /> INDIAN RIVER COUNTY, FLORIDA IN THE PUBLIC RECORDS OF <br /> INDIAN RIVER COUNTY FL <br /> BK : 1983 PG : 723 , Pagel of 12 <br /> AND 01 / 16/2006 at 01 : 04 PM , <br /> JEFFREY K BARTON , CLERK OF <br /> WOODSIDE TUSCANY, LLC COURT <br /> FOR <br /> TUSCANY LAKES SUBDIVISION <br /> FOR THE CONSTRUCTION OF OFF- SITE UTILITIES <br /> THIS AGREEMENT by and between INDIAN RIVER COUNTY , a political subdivision of the <br /> State of Florida, the address of which is 1840 25th Street, Vero Beach , Florida 32960 (hereinafter the <br /> "COUNTY ") and WOODSIDE TUSCANY , LLC , a Florida limited liability company, the address of <br /> which is 2541 Metro Centre Blvd . , West Palm Beach FL 33407 , (hereinafter the DEVELOPER) is <br /> effective upon execution by the second of the two parties . <br /> WHEREAS , the DEVELOPER, in conjunction with the construction improvements at TUSCANY <br /> LAKES SUBDIVISION , is providing water and wastewater facilities to the subject property located at 6125 <br /> 77TH STREET, and more specifically described in Exhibit " A " ; and <br /> WHEREAS , pursuant to Section 918 . 05 , The Code of Indian River County (Ordinance 90 - 16 , as <br /> amended), the COUNTY, requires the DEVELOPER to provide the utility improvements to connect to the <br /> regional facilities , and the COUNTY , pursuant to Section 201 . 11 , of the Code , agrees to reimburse the <br /> DEVELOPER , as provided herein, for the cost of providing these off- site utilities , <br /> NOW , THEREFORE, for and in consideration of the mutual promises set forth herein and other good and <br /> valuable consideration , the COUNTY and DEVELOPER agree as follows : <br /> 1 . OFF- SITE UTILITIES : <br /> The DEVELOPER shall construct the necessary off-site utilities described herein as directed by the Indian <br /> River County Utilities Department . The COUNTY shall reimburse the DEVELOPER for installing Master <br /> Planned off-site utilities as outlined below : <br /> A . 16 - inch Diameter Master Planned Sanitary Force Main west along south side 77 °i Street from South <br /> East corner of 58 `I' Avenue and 77 `h Street to west property line of this project <br /> The DEVELOPER shall furnish and install PVC and PE 16- inch Master Planned Force Main pipe <br /> along the south side of 77 `h Street from the south east corner of 58 `I' Avenue and 77 `f' Street to the west <br /> property line of this project for approximately 2914 linear feet . This force main will be plugged at the <br /> south east corner of 58 `h Avenue and 77th Street and at its west end . <br /> The DEVELOPER will not pay line extension fees for wastewater since the COUNTY is requiring the <br /> DEVELOPER to install a 4 - inch force main parallel to the 16 - inch Master Planned Force Main to <br /> CU)UC - Page I - ? <br /> .
