7� •Za • oq <br /> AGREEMENT T � aQ � 77 <br /> O PURCHASE AND SELL REAL ESTATE <br /> BETWEEN <br /> ALTAMEASE MARTIN HAYES <br /> DEBORAH JEFFERSON <br /> SOLOMON BENJAMIN RUE <br /> BLONDELL BINSON WILLIAMS <br /> CLYDE CLIFFORD BRINSON <br /> DOROTHY MILLER RUE <br /> AND <br /> INDIAN RIVER COUNTY <br /> THIS AGREEMENT TO PURCHASE AND SELL REAL ESTATE ( "Agreement" ) <br /> is made and entered into as of the 20th day of U j bar , 2009 , by and between <br /> Indian River County , a political subdivision of the State of Florida ( "the County" ) , and <br /> Altamease Martin Hayes , Deborah Jefferson , Solomon Benjamin Rue , Blondell Brinson <br /> Williams , Clyde Clifford Brinson and Dorothy Miller Rue ( " Sellers " ) , who agree as <br /> follows : <br /> WHEREAS , Sellers own a parcel of property known as Parcel 221 located at <br /> 6460 85th Street in Sebastian , Florida and a parcel of property known as Parcel 223 <br /> located at 6440 85th Street in Sebastian , Florida , collectively ( " Property" ) . A print out of <br /> the property known as Parcel 221 from the Indian River County Property Appraiser' s <br /> website is attached to this agreement as Exhibit "A " and incorporated by reference <br /> herein . A print out of the property known as Parcel 223 from the Indian River County <br /> Property Appraiser' s website is attached to this agreement as Exhibit " B " and <br /> incorporated by reference herein ; and <br /> WHEREAS , the County , is scheduled to expand CR 510 in the near future and <br /> the road expansion will impact and affect the Sellers ' property ; and <br /> WHEREAS , in order for the County to proceed with its road expansion plans , the <br /> County needs to purchase property to be used as right-of-way from landowners <br /> adjacent to CR 510 ; and <br /> WHEREAS , the County has contacted Sellers and has offered to purchase both <br /> parcels of Property from Sellers to be used as right-of-way ; and <br /> WHEREAS , Sellers are represented by Raymer F . Maguire III of the law firm of <br /> Fixel , Maguire & Willis , 1010 Executive Center Drive , Suite 121 , Orlando , Florida ; and <br /> WHEREAS , the County is prepared to take the Property by using its power of <br /> eminent domain ; and <br /> Page 1 of 7 <br />
