DEP CONTRACT NO . WM836 <br /> AMENDMENT NO. 1 <br /> THIS AGREEMENT as entered into on the 6" day of August, 2002, between the FLORIDA <br /> DEPARTMENT OF ENVIRONMENTAL PROTECTION (hereinafter referred to as the "DEP") and the INDIAN <br /> RIVER COUNTY BOARD OF COUNTY COMMISSIONERS (hereinafter referred to as the "GRANTEE or <br /> CONTRACTOR") is hereby amended. <br /> WHEREAS, due to dry weather conditions the project schedule of the Agreement has been delayed; and, <br /> WHEREAS, due to the aforementioned circumstances, the Grantee has requested and the DEP has <br /> approved, a no-cost time extension of the Agreement; and, <br /> WHEREAS, the completion date of the Agreement needs to be changed to August 7, 2007; and, <br /> WHEREAS, additional changes to the Agreement are necessary. <br /> NOW, THEREFORE, the parties hereto agree as follows : <br /> SECTION II - SCHEDULE OF WORK is hereby revised to change the completion date of the Agreement <br /> to August 7, 2007 . <br /> SECTION IV — COMPENSATION is hereby revised to include a third paragraph which reads as follows: <br /> Grantee matching funds have been used for the acquisition of land for this project. The Grantee <br /> agrees that the funds used to purchase the land shall not be used as match to any other Agreement <br /> supported by State or Federal funds . <br /> -- SECTION VI — MANAGEMENT is hereby revised to change Richard Hicks telephone number to <br /> 850/245 -8229. <br /> SECTION XI — SUBCONTRACTING is modified through the addition of the following language as <br /> Paragraph E. <br /> E . The Department of Environmental Protection supports diversity in its procurement program and <br /> requests that all subcontracting opportunities afforded by this Agreement embrace diversity <br /> enthusiastically. The award of subcontracts should reflect the full diversity of the citizens of the <br /> State of Florida. The Department will be glad to furnish a list of minority owned businesses for <br /> consideration in subcontracting opportunities . <br /> SECTION XXIII—AUDIT: ACCESS TO RECORDS, Item A is deleted in its entirety and replaced with <br /> the following: <br /> A. The Grantee shall maintain books, records and documents directly pertinent to performance under <br /> this Agreement in accordance with generally accepted accounting principles consistently applied. <br /> The DEP, the State, or their authorized representatives shall have access to such records for audit <br /> purposes during the term of this Agreement and for five years following Agreement completion. <br /> In the event any work is subgranted or subcontracted, the contracted shall similarly require each <br /> subgrantee and subcontractor to maintain and allow access to such records for audit purposes. <br /> REMAINDER OF PAGE INTENTIONALLY LEFT BLANK <br /> DEP Contract No. WM836, Amendment No . 1 , Page 1 of 3 <br />
