" <br /> WITNESSETH <br /> WHEREAS , Grand Harbor and the County entered into a Grant of <br /> Restoration , Access and Recreation Easement dated May 3 , 2005 ; and <br /> WHEREAS , the original Site lies adjacent to the Indian River (the " River") <br /> and contains approximately 59 . 08 acres of estuarine wetlands (originally said to contain <br /> 62 acres under the May 3 , 2005 agreement) ; and <br /> WHEREAS , in accordance with the Agreement dated May 3 , 2005 , the <br /> County has been working diligently with the various permitting agencies for approval of <br /> its Project; and <br /> WHEREAS , since the Agreement dated May 3 , 2005 , Grand Harbor has <br /> submitted an application to develop their property to the west of the Site and has offered <br /> to provide to the County an additional 7 . 89 acres as shown by the Prior Easement Line <br /> on Revised Exhibit " B" directly adjacent to the original Site for use in the County's <br /> Project (the "Additional Land ") ; and <br /> WHEREAS , in discussion with the various permitting agencies , the County <br /> recognizes the addition of the 7 .89 acres of the Additional Land will benefit the Project's <br /> approval and reduce or eliminate the amount of mitigation that may be needed as a <br /> result of construction of the Project; and <br /> WHEREAS , subject to the terms and conditions of this Amended <br /> Agreement , Grand Harbor hereby provides to the County the Additional Land to be <br /> included in the easement in the Site as described herein ; and <br /> 1 <br />
