' ARTICLE 23 — RETAINAGE _ <br /> 23 . 01 This Section intentionally left blank. <br /> ARTICLE 24 - CONTRACTS TO BE ASSIGNED <br /> j 24 . 01 OWNER has executed contracts with [ <br /> 1 <br /> for [ 1 <br /> and with [ 1 <br /> for [ 1 <br /> The materials and equipment provided for in these contracts are to be furnished and delivered <br /> to the Site for installation by CONTRACTOR . The contracts will be assigned by OWNER to <br /> CONTRACTOR. Identification of the materials and equipment and the procedures to be <br /> followed appear in paragraph 6 . 21 of the Supplementary Conditions , <br /> 24 . 02 Bidders may examine the documents for these contracts at the Issuing Office . <br /> ' ARTICLE 25 - PARTNERING <br /> 25 . 01 OWNER intends to participate in a partnering process with CONTRACTOR. The <br /> objectives of the process will be to achieve effective and efficient performance of the Work and <br /> completion of the Work within the Contract Price and Contract Times , all in accordance .with the <br /> Contract Documents . <br /> 25 . 02 Participation in the partnering process will be voluntary. To initiate the process , within <br /> U days after the Notice to Proceed the key personnel of OWNER , ENGINEER, <br /> CONTRACTOR , and CONTRACTOR's major Subcontractors will be invited to attend a one-day <br /> seminar followed by a one-day team building workshop to develop a partnering statement. The <br /> seminar and the workshop will be conducted by a neutral facilitator at a time and location <br /> agreed to by OWNER and CONTRACTOR in the general vicinity of the Site . <br /> 25 . 03 The facilitator will be selected by OWNER , subject to approval by CONTRACTOR. <br /> ' Costs of the facilitator and facilities for the initial seminar and workshop will be paid by <br /> OWNER. Thereafter, all facilitator-related and facilities costs will be shared equally by OWNER <br /> and CONTRACTOR with no change in the Contract Price . Each party will pay all costs <br /> associated with the participation of its own personnel . <br /> 25 . 04 It is intended that the initial seminar and workshop sessions be followed by periodic half- <br /> day evaluation sessions approximately every 90 days as agreed to by OWNER and <br /> CONTRACTOR. <br /> 25 . 05 A primary objective of the partnering process is to maximize the potential for resolution <br /> of disputes in a timely and non-adversarial manner. The use of alternative dispute resolution <br /> (ADR) methods will be encouraged in order to promote and maintain amicable working <br /> relationships among the parties .
