J <br />THIS AGREEMENT made as of the 21st day of July in the year of 2008 <br />BETWEEN the Owner. <br />Indian River County, a political subdivision of the State of Florida, 1801 27th Street, <br />Vero Beach, Florida 32960 and the Design/Builder: Barth Construction, Inc., 1717 <br />Indian River Blvd.' Suite 202A Vero Beach, Florida 32960 <br />For the following Project: <br />Design Build Expansion and Renovation to the Indian River County Department of <br />Emergency Services Fire Station #9 Roseland Road, Sebastian, Florida 32958 <br />The architectural services described in Article 3 will be provided by the following person <br />or entity who is lawfully licensed to practice architecture: <br />Name and address <br />eau[ U. Dritenbas, Edlund Dritenbas <br />3inkley,Architects & Associates <br />35 Royal Palm Pointe, Suite D <br />Air` Beach, FL 32960 <br />Registration Relationship to <br />Number Design/Builder <br />AR0009308 Contractual <br />Normal structural, mechanical and electrical engineering services will be provided <br />contractually through the Architect except as indicated below: <br />Name, address and discipline Registration Relationship to <br />Number Design/Builder <br />v <br />The Owner and the Design/Builder agree as set forth below. <br />TERMS AND CONDITIONS — PART 2 AGREEMENT <br />ARTICLE 1 GENERAL PROVISIONS <br />§ 1.1 BASIC DEFINITIONS <br />§ 1.1.1 The Contract Documents consist of the Part 1 Agreement to the extent not <br />modified by this Part 2 Agreement, this Part 2 Agreement, the Design/Builder's Proposal <br />and written addenda to the Proposal identified in Article 14, the Construction <br />Documents approved by the Owner in accordance with Section 3.2.3 and Modifications <br />issued after execution of this Part 2 Agreement. A Modification is a Change Order or a <br />written amendment to this Part 2 Agreement signed by both parties, or a Construction <br />Change Directive issued by the Owner in accordance with Section 8.3. <br />§ 1A.2 The term "Work" means the construction and services provided by the <br />Design/Builder to fulfill the Design/Builder's obligations. <br />2 <br />
