SD -04 - 10 -46 =SIDECFC (2004020217 -51666 ) _ <br /> THIS MODIFICATION , made and entered into this 16' hday of February , <br /> 2009 , by and between CENTEX HOMES , a Nevada general partnership, <br /> hereinafter referred to as " Developer'' , and INDIAN RIVER COUNTY , a political <br /> subdivision of the State of Florida , by and through its Board of County <br /> Commissioners , hereinafter referred to as " County" . <br /> WITNESSETH <br /> WHEREAS ; Developer entered into a Contract for Construction of <br /> required Sidewalk Improvements No .. 8D -04-10 -46 - SIDECFC (2004.020217 - <br /> 51666 ) guaranteeing the completion of certain required sidewalk . improvements <br /> on or before December 12 , 2008 and posted a SunTrust Bank Irrevocable Letter <br /> of Credit No . P00378.6 in the amount of $ 269 , 790 . 00 as security to guarantee <br /> completion ; and <br /> WHEREAS , a portion of sidewalk-improvements has been completed ; and <br /> WHEREAS , the developer has requested an additional two - year extension <br /> to December 12 , 2010 to complete the remaining required sidewalk <br /> improvements ; <br /> NOW , THEREFORE , IN CONSIDERATION OF THE MUTUAL <br /> COVENANTS AND. PROMISES HEREIN CONTAINED , the parties agree as <br /> follows : <br /> 1 . . P003786 in the <br /> amount of $269 ;790 . 00 on deposit for internal and external sidewalks <br /> representing 125 % of the remaining sidewalk improvements to be completed <br /> must be amended rto reflect the named beneficiary ' s change of address to 1801 <br /> 27 "' Street , Vero Beach , Florida 32960 . Said amendment must be received by <br /> the County Attorney ' s Office in acceptable form no Later than 5 : 00 p . m . on April <br /> 15 , 2009 or this Modification will be deemed null and void , the Developer will be <br /> in default , and the letter of credit will be called . <br />
