on a time and material basis . A written estimate of the <br /> required expenditures will be forwarded to the District <br /> within 5 working days after completion of the emergency <br /> services . After mitigation of the emergency or safety <br /> hazard , Contractor will then proceed to coordinate and <br /> schedule the non - emergency repairs as set forth in <br /> paragraph 2 . 3 . 1 above . <br /> 2 . 4 . Contractor shall be permitted annually to request a <br /> price adjustment to the payment price for Landfill <br /> Operations and Landfill gas system operation and <br /> maintenance pursuant to this paragraph 2 . 4 , with the first <br /> price adjustment to be effective , if granted , on January 1 , <br /> 2005 . The Contractor shall submit annually to the District <br /> a written request and appropriate documentation , no later <br /> than June 15 , commencing June 15 , 2004 for an adjustment to <br /> the payment price for Landfill Operations and Landfill gas <br /> system operation and maintenance . Such request shall not <br /> be unreasonably refused . Any such adjustment granted by <br /> the District shall become effective on January 1 of the <br /> following year for the remaining term of the Contract , <br /> commencing January 1 , 2005 . The adjustment shall not <br /> exceed 75 percent of the change of the Consumer Price Index <br /> ( CPI ) , specifically , the Urban Consumers Index , published <br /> by the U . S . Department of Labor , Bureau of Labor <br /> Statistics , for the Southern States . Downward adjustments <br /> resulting from a negative CPI shall be made by the <br /> District , when appropriate , without a request from the <br /> Contractor . <br /> 2 . 4 . 1 . The adjustments shall be computed as follows : For <br /> each subsequent fiscal year of the Contract , the net <br /> percentage change shall be 75 percent of the difference <br /> between the CPI as of the immediately preceding January 1 <br /> and the second preceding January 1 divided by the CPI as of <br /> the second preceding January 1 . The following formula <br /> shall be used for the cost adjustment : <br /> ( XLX, X 0. 75) + 1 <br /> X, <br /> Cost Adjustment = where , X1 = CPI for second preceding <br /> January 1 ; X2 = CPI for immediately preceding January 1 . <br /> 4 <br />
