The Demineralization Concentrate is <br /> generated as a by-product of the system at a Maximum Daily Flow (MDF) of 1 . 5 MGD . The <br /> Demineralization Concentrate is chlorinated to treat Hydrogen Sulfide and aerated to remove the <br /> chlorine residuals . The effluent is discharged to the South Relief Canal , a Class III fresh surface <br /> water body of the State via Outfall D-001 . This outfall consists of a 14 inch diameter pipe with a <br /> free fall discharge 15 feet from shore ( "Facility") . Respondent operates the treatment system under <br /> Department wastewater permit No . FL0037940 which expired on December 14, 2005 . The Facility <br /> is located at 1550 SW 91" Avenue , Vero Beach, Indian River County, Florida, Latitude 27 ° 35 ' <br /> 27 . 37" North, Longitude 80° 24 ' 0 . 55 " West. The Facility is owned by and is operated under the <br /> name of IRCUD = South County Demineralization Concentrate NPDES Discharge . <br /> 4 , This Facility is permitted under delegated authority from the USEPA (U . S . <br /> Environmental Protection Agency) , On June 16 , 2005 , the Department received a permit renewal <br /> application for the Facility and the expiring permit was administratively continued . A file review <br /> indicated that the Facility was exceeding the toxicity, gross alpha particle activity, total radium 226 <br /> + radium 228 and specific conductance limits in the permit. Numerous requests for additional <br /> information and file reviews didn ' t provide reasonable assurance to the Department that the Facility <br /> could meet the proposed effluent limits . <br /> 5 . The discharge receiving waters of the South Relief Canal do not have sufficient <br /> dilution for a mixing zone and recent experience indicate that it would be very unlikely that the <br /> USEPA would grant a mixing zone . The Respondent will be required to provide an alternate <br /> discharge location. <br /> 6 . Having reached a resolution of the matter the Department and the Respondent <br /> mutually agree and it is <br /> 2 of 17 OGC File No . 084661 <br />
