.r <br /> SPECIAL CONDITIONS FOR PERMIT NO . 05m37 <br /> FOR <br /> INDIAN RIVER COUNTY.— 41sT STREET ROADWAY IMPROVEMENTS <br /> PROJECT NUMBER 0016 AND NUMBER 0236 <br /> 1 ) The Water Control Plan for Indian River Farms Water Control District requires, <br /> .r and must protect the right of all abutting ownership parcels ( 1 /4 mile north and <br /> south) fronting on the Sub-lateral A- 6 (41St Street) alignment to drain into said <br /> canal . As a special condition of this permit, all individually owned parcels of <br /> , r land (currently deVeloped, improved 'or undeveloped) fronting along the north <br /> and south sides of 41s' Street/Sub-lateral A-6 Canal alignment shall be <br /> furnished/provided a legal positive drainage outfall connection to the proposed <br /> culverts and/or remaining open ditch section of the Sub-lateral A-6 Canal within <br /> the project limits . Such connections shall provide a minimum 2 "/24 hour <br /> stormwater discharge capacity for a 24-hour/25 year storm event for each such <br /> parcel . <br /> 2 ) To prevent the ponding of water, over bank discharge of stormwater and the <br /> 1W resulting canal bank erosion, all canal berm areas , along the open ditch sections <br /> within the limits of this project, shall be sloped away from the top of bank, a <br /> minimum of 2 % (maximum 3 %) to the top of the nearest adjacent curb and/or <br /> .r pavement. <br /> Said berm to be compacted and stabilized to provide passage and operation of <br /> .o heavy canal maintenance equipment . <br /> 3 ) Indian River Farms Water Control District assumes no liability or responsibility <br /> ow for the installation, use , operation, repair, replacement or maintenance of the <br /> culverts placed within, or into Sub-lateral A- 6-E Canal as shown on plans of <br /> these projects . <br /> Im <br /> A regular inspection and maintenance schedule of the long runs of culverted <br /> sections in Sub-lateral A- 6 Canal shall be established/provided by the County . <br />.. <br /> The District will monitor the flow of stormwater flow through the culverted <br /> sections in Sub-lateral A-6 Canal during events and advise the County of any <br /> imminent necessity to clean and/or clear obstructions from said culverts . <br /> In the event such action is not taken by the County in a timely manner, the <br />"' District retains the paramount right to contract/provide such service at the <br /> County ' s expense . <br />'r 4) This permit is issued based on final plans submitted with permit application <br /> signed and sealed by Christopher J . Kafer, Jr . P .
