.r SPECIAL CONDITIONS FOR PERMIT NO . 05m37 FOR INDIAN RIVER COUNTY.— 41sT STREET ROADWAY IMPROVEMENTS PROJECT NUMBER 0016 AND NUMBER 0236 1 ) The Water Control Plan for Indian River Farms Water Control District requires, .r and must protect the right of all abutting ownership parcels ( 1 /4 mile north and south) fronting on the Sub-lateral A- 6 (41St Street) alignment to drain into said canal . As a special condition of this permit, all individually owned parcels of , r land (currently deVeloped, improved 'or undeveloped) fronting along the north and south sides of 41s' Street/Sub-lateral A-6 Canal alignment shall be furnished/provided a legal positive drainage outfall connection to the proposed culverts and/or remaining open ditch section of the Sub-lateral A-6 Canal within the project limits . Such connections shall provide a minimum 2 "/24 hour stormwater discharge capacity for a 24-hour/25 year storm event for each such parcel . 2 ) To prevent the ponding of water, over bank discharge of stormwater and the 1W resulting canal bank erosion, all canal berm areas , along the open ditch sections within the limits of this project, shall be sloped away from the top of bank, a minimum of 2 % (maximum 3 %) to the top of the nearest adjacent curb and/or .r pavement. Said berm to be compacted and stabilized to provide passage and operation of .o heavy canal maintenance equipment . 3 ) Indian River Farms Water Control District assumes no liability or responsibility ow for the installation, use , operation, repair, replacement or maintenance of the culverts placed within, or into Sub-lateral A- 6-E Canal as shown on plans of these projects . Im A regular inspection and maintenance schedule of the long runs of culverted sections in Sub-lateral A- 6 Canal shall be established/provided by the County . .. The District will monitor the flow of stormwater flow through the culverted sections in Sub-lateral A-6 Canal during events and advise the County of any imminent necessity to clean and/or clear obstructions from said culverts . In the event such action is not taken by the County in a timely manner, the "' District retains the paramount right to contract/provide such service at the County ' s expense . 'r 4) This permit is issued based on final plans submitted with permit application signed and sealed by Christopher J . Kafer, Jr . P .
