Gentile : <br /> On August 26 , 2004 , the District received your written request to modify permit number <br /> 40-061 -89085- 11 by proposing minor changes to the location of the swale and sidewalk. <br /> This request was updated with additional information by a submittal received by the <br /> District on December 13 , 2004 . Specifically, staff understands that the proposed <br /> r modification consists of the following : <br /> The construction plans received on August 26 , 2004 , and again on December 13 , 2004 , <br /> show minor changes to the system design including moving the location of the swale to <br /> the east side of the roadway. <br /> r Based on the information provided , your request qualifies for a letter modification <br /> pursuant to Section 40C-4 . 331 ( 1 ) (b) , Fla . Admin . Code . <br /> r All of the terms and conditions of permit number 40-061 -89085- 1 will remain in effect . <br /> r Please be advised the District has not published a notice in the newspaper to advise the <br /> public that it is issuing this letter modification . If you do not publish notice in the <br /> newspaper, a party's right to challenge the issuance of this letter modification extends <br /> for an indefinite period of time. If you wish to have certainty that the period for filing <br /> such a challenge is closed , then you may publish , at your own expense , such a notice in <br /> a newspaper of general circulation within the area that includes the project to Vrhich the <br /> modification applies . A copy of the form of the notice is attached for your use . Pursuant <br /> to Section 40C- 1 . 1007, Florida Admin .
