<br /> GC 57 .4 Assignment. The Contractor shall not assign the Contract as a whole or in part
<br /> without the written consent of the Owner, nor shall the Contractor assign any monies due or to ■
<br /> become due to him hereunder without the previous written consent of the Owner and its surety.
<br /> Assigning the Contract shall not relieve the Contractor or his surety from any contract obligations .
<br /> GC 57 .5 Specific Waiver. Any waiver issued by the Owner of any provision of the Contract r
<br /> Documents shall only be effective if issued in writing by the Owner and shall be specific, shall apply
<br /> only to the particular matter concerned , and shall not apply to other similar or dissimilar matters .
<br /> Either party's failure to enforce strict performance of any covenant, term , condition , promise,
<br /> agreement or undertaking set forth in the Contract shall not be construed as a waiver or ■
<br /> relinquishment of any other covenant, term , condition , promise, agreement or undertaking set forth
<br /> herein , or waiver or relinquishment of the same covenant, term , condition , promise, agreement or
<br /> undertaking at any time in the future. •
<br /> GC 57 .6 Public Entity Crimes . By executing a Contract with Owner, Contractor certifies, in
<br /> accordance with F.S. 287. 133, that Contractor, its affiliates, suppliers, subcontractors and consultants
<br /> who will perform under this Agreement have not been placed on the convicted vendor list maintained ■
<br /> by the State of Florida Department of Management Services within the 36 months immediately
<br /> preceding the date of the Invitation to Bid .
<br /> ■
<br /> GC 57 .7 Compliance with Laws . Contractor shall comply with all applicable City, State and
<br /> Federal laws relating to the provision of services under this Contract, now or hereafter in effect.
<br /> Contractor shall complywith all applicable City, State and Federal laws relating to wages, hours , and
<br /> all other applicable laws relating to the employment or protection of employees, now or hereafter in ■
<br /> effect. It shall not be grounds for a change order that Contractor failed to investigate the codes and
<br /> regulations of all applicable government agencies with jurisdiction over the work.

<br /> GC 57 .8 Small Business Requirements. Contractor shall comply with the Citys Small
<br /> Business Ordinance set forth in Chapter 66 of the City Code, which is incorporated herein by
<br /> reference .
<br /> •
<br /> GC 57 .9 No Solicitation. Contractor has not employed or retained any person employed by the
<br /> Owner to solicit or secure the Contract and it has not offered to pay, paid , or agreed to pay any person
<br /> employed by the Owner any fee, commission percentage, brokerage fee, or gift of any kind contingent ■
<br /> upon or resulting from the award of this Agreement.
<br /> GC 57 . 10 Non-Collusion . Contractor certifies that it has entered into no agreement to commit a
<br /> fraudulent, deceitful , unlawful or wrongful act, or any act which may result in an unfair advantage over ■
<br /> other bidders or contractors. (F.S. 838.22)
<br /> GC 57. 11 Equal Employment Opportunity: Non-Discrimination. Contractor will not discriminate
<br /> against any employee or an applicant for employment because of race, color, religion , sex, national ■
<br /> origin or handicap . Contractor shall take affirmative action to ensure that applicants are employed
<br /> and that employees are treated fairly during employment without regard to race, color, religion , sex,
<br /> natural origin or handicap . ■
<br /> GC 57. 12 Apprentices . If the Contractor employs apprentices on the project, the behavior of
<br /> the Contractor and the Owner shall be governed by the provisions of Chapter 446, Florida Statutes,
<br /> and by applicable standards and policies governing apprentice programs and agreements established ■
<br /> by the Division of Labor of the State of Florida Department of Labor and Employment Security. The
<br /> Contractor will include a provision similar to the foregoing sentence in each subcontract .

<br /> GC 57. 13 Unauthorized Aliens . The Owner shall consider the employment by Contractor or its
<br /> subcontractors, any alien not authorized to work by the immigration laws or the Attorney General of
