Non-Waiver of District's Regulatory Powers. Nothing <br /> contained in this Agreement shall be construed as a waiver of or contract <br /> with respect to the regulatory and permitting authority of the District as it <br /> now or hereafter exists under applicable laws, rules and regulations. <br /> 19 . Non-Waiver of Sovereign Immunity. Nothing contained in <br /> this Agreement or in any Instruments executed pursuant to the terms of this <br /> Agreement shall be construed as a waiver or attempted waiver by the District <br /> of its sovereign immunity under the constitution and laws of the State of <br /> Florida; provided, however, that this paragraph shall not be construed as an <br /> attempt by the District to negate any partial waiver of sovereign immunity <br /> made by the Legislature under the provisions of The Tort Claims Act, Section <br /> 768.28, Florida Statutes or any future statute or Act adopted by the Florida <br /> Legislature. <br /> 20. Proceeds of Sale and Closing Procedure. The deeds shall be <br /> recorded at closing upon evidence of title, if applicable, continued at the <br /> District's, expense, to show title in Buyer, without any encumbrances or <br /> changes which would render Seller's title unmarketable from the date of the <br /> last evidence, and the executed Closing documents may be held in escrow by <br /> the Closing Agent or by such other escrow agent as may be mutually agreed <br /> 11 <br /> 453 <br />
