EXHIBIT "B" <br />TITLE EXCEPTIONS <br />SCHEDULE E II <br />(Exceptions) <br />Schedule B of the policy or policies to be issued will contain exceptions to the following matters unless <br />the same are disposed of to the satisfaction of the Company; <br />1. Defects, liens, encumbrances, adverse claims or other matters, if any, created, first appearing in the <br />public records or attaching subsequent to the effective date hereof but prior to the date the Proposed <br />Insured acquires for value of record the estate or interest or mortgage thereon covered by this <br />Commitment. <br />2. All assessments and taxes for the year 2008 and all subsequent years, which are not yet due and <br />payable. <br />NOTE; Real estate taxes for the year 2007 are paid; 2007 gross amount being $398.66; Tax I.D. <br />#32-3 9-30-00000-1000-00001/0. <br />3. Any lien, or right to a lien, for services, labor or material heretofore or hereafter furnished, imposed <br />by law and not shown by the public records. <br />4. Any encroachments, easements, measurements, variations in area or content, parry walls or other facts <br />which a correct survey of the premises would show. <br />5. Rights or claims of parties in possession not shown by the public records. <br />6. Any right, title or interest as to oil, gas and/or minerals as referred to in that certain instrument <br />recorded February 2, 1951, in Deed Book 63. Page 483, Public Records of Indian River County, <br />Florida. NOTE: The right of entry has been released <br />7. Any rights or interest as indicated by that certain Stumpage Sale Contract recorded in Official Record <br />Book 191. Page 770. Public Records of Indian River County, Florida. <br />S. Rights of others in and to any canals located upon the subject property. <br />10. Notwithstanding the insuring provisions of the Commitment and/or Policy, legal right of access to <br />and from the insured land is not insured. <br />
