Instrument Prepared and should he <br />returned to: <br />Indian River County Attorney's Office <br />Marian Fell, Esquire <br />18012 7'h Street, <br />Vero Beach, FL 32960 <br />NOTICE OF LIMITATION OF USE <br />This Notice of Limitation of Use, dated April _, 2008, gives notice that the real <br />property located in Indian River County, Florida, more specifically described in Exhibit "A" <br />attached hereto and incorporated herein by this reference (the "Property") is jointly owned by <br />St. Johns River Water Management District, a public body existing Chapter 373, Florida <br />Statutes, whose address is P.O. Box 1429, Palatka, FL 32178 (the "District") and Indian River <br />County, a political subdivision of the State of Florida, whose address is 1801 27`h Street, Vero <br />Beach, FL 32960 (the "County"), in accordance with the terms and provisions of an <br />"Assignment, Settlement, and Covenant Agreement" entered into between the District and the <br />County dated April , 2008 (the "Agreement"). The use and management of the Property <br />is restricted as set forth in the Agreement and also in that certain Land Management Plan for <br />the Sand Lakes Restoration Area dated April 12, 2002 (the "Plan"). As set forth in the <br />Agreement, the Plan may be amended from time to time with the prior written approval of the <br />District and the County; and the Property will be available for public access and public <br />passive recreational uses consistent with the objectives of the Plan.
