DEP AGREEMENT NO. G0182 c� U b tO — 3 ✓ r/. <br /> AMENDMENT NO. 1 <br /> THIS AGREEMENT as entered into on the 11 " day of April, 2006, between the STATE OF FLORIDA <br /> DEPARTMENT OF ENVIRONMENTAL PROTECTION (hereinafter referred to as the "Department" or "DEP") <br /> and the INDIAN RIVER COUNTY BOARD OF COUNTY COMISSIONERS, (hereinafter referred to as "Grantee" <br /> or "Recipient") is hereby amended. <br /> WHEREAS, due to a higher than estimated construction cost Indian River County has come up with an <br /> alternate stormwater treatment system which will be easier to construct and easier to maintain; and, <br /> WHEREAS, the cost-effective treatment system will utilize a pumpout sedimentation sump and a series of <br /> self-cleaning bar screens reducing TSS by 45%, total phosphorus by 36% and total nitrogen by 23% ; and, <br /> WHEREAS, the Department agrees that the alternative system is in the best interest of the project; and, <br /> WHEREAS, to implement this alternative system, Attachment A, Grant Work Plan needs to be revised; <br /> and, <br /> WHEREAS, additional changes to the Agreement are necessary. <br /> NOW, THEREFORE, the parties hereto agree as follows : <br /> -- Paragraph 3E is hereby revised to change the Grantee's required match amount to $3,298,475 . <br /> -- Paragraph IOB is hereby revised to change the form number listed to DFS-A2-NS. <br /> -- Attachment A, Grant Work Plan, is hereby deleted in its entirety and replaced with Attachment A-1 , <br /> Revised Grant Work Plan, attached hereto and made a part of this Agreement. All references in the <br /> Agreement to Attachment A shall hereinafter refer to Attachment A-1 , Revised Grant Work Plan. <br /> -- Attachment E, Special Audit Requirements, is hereby deleted in its entirety and replaced with Attachment <br /> E-1, Revised Special Audit Requirements, attached hereto and made a part of this Agreement.
