aoo � - ay ! <br /> � L <br /> C) U <br /> GRANT OF EASEMENT <br /> This Grant of Easement ("Easement") is made and executed this 9th day of <br /> October 12Q 0 � by Indian River County, Florida, apolitical subdivision of the State <br /> of Florida, whose address is 180127 th Street, Vero Beach, Florida 32960 ("Grantor"), in favor of <br /> S&S Rentals, L.L. C., a Florida limited liability company, whose address is 400 High Point Drive, <br /> Suite 500, Cocoa, Florida 32926 ("Grantee") . <br /> WITNESSETH <br /> WHEREAS, Grantee is the Owner and Developer of that certain piece of property in Indian <br /> River County, more particularly described on Exhibit "A", attached hereto and made a part hereof <br /> ("Grantee 's Property"); and <br /> WHEREAS, Grantor is the Owner and holder in fee simple title of that certain property in <br /> Indian River County more particularly described on Exhibit `B", attached hereto and made a part <br /> hereof ("Easement Property"); and <br /> WHEREAS, in conjunction with Grantee' s development of Grantee ' s Property, Grantee and <br /> Grantor have entered into a Developer' s Agreement dated October 9, 2007, ("Developer' s <br /> Agreement"), and <br /> WHEREAS , pursuant to the Developer' s Agreement the County agreed to provide a <br /> perpetual, non-exclusive stormwater management and drainage easement for stormwater runoff from <br /> Grantee' s Property; <br /> NOW, THEREFORE, for and in consideration of the mutual covenants, terms, conditions, <br /> and restrictions contained in the Developer' s Agreement and contained herein, the receipt and <br /> sufficiency of which are hereby acknowledged, Grantor hereby grants and conveys to Grantee a <br /> perpetual, non-exclusive easement for stormwater storage over the Easement Property, more <br /> particularly described on Exhibit "B", attached hereto and made a part hereof, together with a <br /> perpetual non-exclusive easement for drainage from the Grantee ' s Property to the Easement <br /> Property. <br /> The purpose of the stormwater and drainage easement is to convey and store stormwater from <br /> the buildings and fuel island canopy on the Grantee' s Property. <br /> The County shall be responsible for all construction and maintenance of the Easement <br /> Property. <br /> This Easement shall be perpetual in nature, shall ran with the land as an appurtenance to <br /> Grantee ' s Property, and shall be given to Grantee, its successors, and assigns . <br /> 1 <br />
