The Board reconvened at 1;00 o'clock, and the Chairman stated they <br />would take up Item #6 of the Notice first as Mr. Kaser was present. Mr. <br />William Kaser was recognized and stated he had applied for the rezoning to <br />C-1 Commercial for the reason that he had a commercial building on the <br />property prior to zoning and under the present zoning would not be able <br />to enlarge or even build back in case of a fire. There were none present <br />against the proposed rezoning. MotiOn was then made by Commissioner Mac- <br />donald, seconded by Mr. Waddell and unanimously carried that the change for <br />Item #6 be allowed. <br />Item #1 of the Notice was then discussed and Mr. Van Ausdale who <br />requested the rezoning was present and stated their plant and other install- <br />ations were located on these lands and would therefore like to have them <br />rezoned to.M-1-A, restriced Industrial. As there were none present against <br />the rezoning, Motion was made by Commissioner Waddell, seconded by <br />Commissioner Hamilton and unanimously carried, for the rezoning as set <br />forth in Item #1. <br />Item #2 of the Notice was then discussed and Mr. Van Ausdale stated <br />these were the lands they were now mining and would mine in the future. <br />Bob Jackson, Attorney for Mr. W. E. Kelly who owns lands surrounded by <br />those to be rezoned voiced an objection on the ground that,his clients <br />land was presently zoned R-3 transient District and had in mind some day <br />to put up motels on" his land and did not like the idea of the land surround- <br />ing his to decrease -,in zoning and did not like the idea ofmining so close <br />;i <br />to his property. Mr: Van Ausdale stated that the land Mr. 'Jackson referred <br />to and that of his surrounding was not nothing but marsh land and the best <br />way to recover this land was to mine same. He further stated the land <br />was surrounded by colored property and would not be a very good site for <br />a`motel. After some further discussion in the matter, Motion was made <br />by Commissioner Waddell, seconded by Mr. Macdonald and carried, for the <br />rezoning as set forth in Item 2 of the Notice. <br />Item #3 was then discussed which is a proposed paragraph, -.to be added <br />under Section 7, F-1 Agrigultural District, which said paragraph has to ' <br />do with mining. Mr. Jackson also objected to this paragraph being added <br />to the Resolution stating that the Board should obtain a performance bond <br />from anyone mining the.lands to see that the land was placed in a livable <br />condition.
