mom <br /> DEVELOPER' S AGREEMENT BETWEEN <br /> INDIAN RIVER COUNTY, FLORIDA, <br /> HARBOR TRADE CENTRE , LLC , <br /> AND WAHOO MANAGEMENT, INC . <br /> FOR 45TH STREET IMPROVEMENTS <br /> THIS AGREEMENT, entered this 24th day of _ May , 2005 , by and <br /> between INDIAN RIVER COUNTY, FLORIDA a political subdivision of the State of Florida, <br /> 1840 25th Street, Vero Beach, Florida, 32960 hereafter called COUNTY, HARBOR TRADE <br /> CENTRE, LLC , 900 21st Street, Vero Beach, FL 32960 , 772 - 569 -3799 AND AHOO <br /> MANAGEMENT, INC . , 5155 N. AIA, Apt . C311 , Ft. Pierce, Fl . 34949 , herea er referred to <br /> as the DEVELOPERS . <br /> WITNESSETH <br /> WHEREAS , the DEVELOPERS have applied to build commercial developments in <br /> Indian River County, Florida, as follows : <br /> Harbor Trade Centre, LLC to be known as Harbor Trade Center Project Number <br /> 99120042 on the south side of 45th Street, east of US 1 and <br /> Wahoo Management, Inc . to be known as Wahoo Retail, Project Number 001060232 on <br /> the north side of 45th Street, east of US 1 . <br /> The legal description of each development is attached as Exhibit "A" and incorporated <br /> herein by reference ; and <br /> WHEREAS , the COUNTY and DEVELOPERS share mutual concerns w th respect to <br /> roadway and drainage improvements to 45th Street and acquisition of additional 45 th Street right- <br /> of-way; <br /> WHEREAS , the COUNTY has requested to purchase 1 ,405 square feet o property from <br /> of Harbor Trade Center, LLC to provide continuous right of way width on 45th Street; the sketch <br /> and legal description of which is attached as Exhibit ` B " and incorporated herein by reference ; <br /> and <br /> WHEREAS , both the COUNTY and DEVELOPERS can mutually benefit through a <br /> joint effort that will provide for design, engineering and construction of improverr ents to 45th <br /> Street including left turn lanes, an east bound right turn lane into Harbor Trade Center (not <br /> required by Land Development Regulations) , continuous three (3 ) lane width of 45t" Street <br /> 1 <br />
