Reid, Es <br />Bryant, Mill d Olive, P.A. <br />201S onroe Street, Suite 500 <br />RESERVED FOR USE BY <br />CLERK OF CIRCUIT COURT <br />1559772 <br />THIS DOCUMENT HAS BEEN RECORDED <br />IN THE PUBLIC RECORDS OF <br />INDIAN RIVER COUNTY FL <br />BK: 1758 PG:516, Pagel of 7 <br />07/13/2004 at 10:28 AM, <br />JEFFREY K BARTON, CLERK OF <br />COURT <br />THIS FIRST AMEND_,N�iENT TO COLLATERAL DEVELOPMENT AGREEMENT (the "First <br />Amendment") is made as of the AMEN <br />ay of tD(�,-�/�,P , 2004, between LOS ANGELES DODGERS LLC, a <br />Delaware limited liability company (the "Dodgers"), and DODGERTOWN VENTURE, LLLP, a Delaware <br />limited liability limited partnership (the "Developer"). <br />WITNESSETH: <br />WHEREAS, Los Angeles Dodgers, Inc. and Vero Acquisition, LLLP executed that certain Collateral <br />Development Agreement, dated as of August 29, 2001, and recorded in Official Records Book 1426, Page 0596, <br />of the Public Records of Indian River County, Florida (the "Collateral Development Agreement"), which <br />Collateral Development Agreement was consented to by INDIAN RIVER COUNTY, FLORIDA, a political <br />subdivision of the State of Florida (the "County"); and <br />WHEREAS, the Dodgers have succeeded to the interest of Los Angeles Dodgers, Inc. under the <br />Collateral Development Agreement; and <br />WHEREAS, Developer has succeeded to the interest of Vero Acquisition, LLLP under the Collateral <br />Development Agreement; and <br />WHEREAS, pursuant to a Special Warranty Deed dated on or about the date hereof, and which is to be <br />recorded in the Public Records of Indian River County, Florida simultaneously with the recording of this First <br />Amendment, Developer has conveyed to the County a portion of the Adjacent Land consisting of approximately <br />9.1297 acres, as more particularly described in Exhibit "A," attached hereto and made a part hereof (the "Parking <br />Property"); and <br />WHEREAS, pursuant to a Special Warranty Deed dated on or about the date hereof, and which is to be <br />recorded in the Public Records of Indian River County, Florida simultaneously with the recording of this First <br />Amendment, Developer has conveyed to the County a portion of the Adjacent Land consisting of approximately <br />1.2064 acres, as more particularly described in Exhibit "B," attached hereto and made a part hereof (collectively, <br />the 'Right -of -Way Parcels"); and <br />{FT218401;3 } <br />
