13 . Subcontractor: Any person , firm or corporation other than the CONTRACTOR supplying labor or <br /> materials for work being performed under these specifications . <br /> 14 . Substantial Completion : The date certified by the Engineer when the construction of the Project , <br /> or a specified part thereof, is sufficiently completed, in accordance with the Contract Documents , <br /> so that the Project or specified part can be utilized for purposes for which it was intended . <br /> 15 . Surety : The corporate body which is bound with and for the CONTRACTOR , and which <br /> contracts responsibility for his acceptable bid, performance and maintenance of the Project and <br /> for his payment of all obligations pertaining thereto . <br /> 16 . Work : All labor, materials and incidentals required for the construction of the improvement for <br /> which the contract is made , including superintendents , use of equipment, and tools , and all <br /> services and responsibilities prescribed or implied, which are necessary for the complete <br /> performance by the CONTRACTOR of his obligations under the Contract . Unless otherwise <br /> specified herein or in the Contract, all costs of liability and of performing the work shall be at the <br /> Contractor ' s expense . <br /> SPECIFICATIONS <br /> All sections of the specifications and all supplementary documents are essential parts of the contract <br /> and requirements occurring in one area as though occurring in all . These specifications and <br /> documents in their entirety shall be included in , and made a part of, the contract between the County <br /> and the successful bidder. <br /> In the event there is any conflict between the terms and conditions contained in the specifications , the <br /> precedence of the specifications shall be as follows : <br /> 1 . Addenda or modifications of any nature , if any <br /> 2 . Supplementary conditions , if any <br /> 3 . Technical specifications , if any <br /> 4 . Special provisions <br /> 5 . General conditions <br /> 6 . Instructions to bidders <br /> 7 . Bid form <br /> 8 . Invitation to bid <br /> There will be no oral interpretations of these specifications . Any bidder/proposers in doubt as to the <br /> true meaning of any part of the specifications or related documents may submit a written request to <br /> the Purchasing Manager for interpretation thereof. The Purchasing Manager shall receive all requests <br /> for interpretation or corrections no later than ten (10 ) days prior to the deadline for <br /> submitting <br /> bids/Bids . Any interpretation to a bidder will be made only by an addendum duly issued and a copy <br /> of such addendum will be mailed and delivered to each bidder receiving a set of documents . <br /> Page 5 of 55 <br />
