SECTION 00520 - AGREEMENT <br /> THIS AGREEMENT is by and between INDIAN RIVER COUNTY, a Political Subdivision of the <br /> State of Florida organized and existing under the Laws of the State of Florida , (hereinafter called <br /> OWNER) and DICKERSON FLORIDA, INC. (hereinafter called CONTRACTOR) . <br /> OWNER and CONTRACTOR, in consideration of the mutual covenants hereinafter set forth , <br /> agree as follows: <br /> ARTICLE 1 - WORK <br /> 1 . 01 CONTRACTOR shall complete all Work as specified or indicated in the Contract <br /> ' Documents . The Work is generally described as follows : <br /> The Contractor shall construct a stormwater collection , conveyance , and detention <br /> system (6 ± acre wet pond ) in a poorly drained area west of the Florida East Coast <br /> Railroad track . It shall also construct a stormwater collection and conveyance <br /> system in the western right-of-way of U . S . Highway No . 1 . Stormwater runoff will <br /> drain into concrete drainage structures and it will be conveyed by concrete pipe . <br /> The Work also includes a bore and jack underneath the railroad track. The project <br /> is in the vicinity of the City of Vero Beach Municipal Airport and it will be regulated by <br /> the Federal Aviation Authority. Other permitting authorities include St. Johns River <br /> Water Management District and the Florida Department of Transportation . <br /> ARTICLE 2 = THE PROJECT <br /> 2001 The Project for which the Work under the Contract Documents may be the whole or only a <br /> part is generally described as follows : <br /> Project Name : EAST GIFFORD STORMWATER IMPROVEMENTS <br /> County Project Number 9219 <br /> Project Address : The project is located south of 43rd Street, north of South Gifford <br /> Road (41st Street) , west of U . S . Highway 1 , and east of the Indian River Farms Water <br /> Control District. <br /> ARTICLE 3 — ENGINEER <br /> 3 . 01 The Indian River County Public Works Department is hereinafter called the ENGINEER <br /> and will act as OWNER's representative , assume all duties and responsibilities , and have <br /> the rights and authority assigned to ENGINEER in the Contract Documents in connection <br /> with the completion of the Work in accordance with the Contract Documents , <br /> ARTICLE 4 - CONTRACT TIMES <br /> 4 . 01 Time of the Essence <br /> A.
