12 . 05 MINORITY BUSINESS ENTERPRISE ( MBE ) / WOMEN ' S BUSINESS ENTERPRISE <br /> ' (WBE ) UTILIZATION : <br /> A. In accordance with EPA's Program for Utilization of Small , Minority and Women 's <br /> ' Business Enterprises in procurement under assistance programs , the apparent <br /> Successful Bidder before executing the Contract, shall ensure , to the fullest extent <br /> possible , that at least the negotiated fair share percentages of Federal funds for <br /> 1 subcontracts for supplies , construction , equipment or services are made available by the <br /> apparent Successful Bidder to organizations owned or controlled by socially and <br /> economically disadvantaged individuals , women and historically black colleges and <br /> ' universities . The Federal funds for the construction phase of this project are $360 , 000 . <br /> B . The Bidder shall include in its bid documents , the fair share percentages set forth below. <br /> ' The apparent Successful Bidder shall achieve , to the fullest extent possible , the State of <br /> Florida 's fair share objective and shall require its subcontractors to comply with 40 CFR <br /> 30 .44 (b ) , 31 . 36 (e ) , 35 . 3145 (d ) , 35 . 6580 or the Drinking Water State Revolving Fund <br /> ( SRF ) Program Guidelines , as appropriate . The negotiated fair share commitments for <br /> ' the State of Florida are : <br /> 1 . Construction : 10% MBE and 11 % WBE . <br /> C . To evaluate compliance with the " Fair Share" policy, the apparent Successful Bidder <br /> shall comply with the six affirmative steps stated in 40 CFR 30 . 44 ( b ) , 40 CFR 31 . 36 (e ) , <br /> 35 . 3145 (d ) , 35 . 6580 , as appropriate . <br /> D . If the Bidder does not want to rely on Florida 's MBE/WBE goals , the Bidder shall submit <br /> proposed MBE/WBE goals with its bid , based on availability of qualified minority and <br /> 1 women -owned businesses to do work in the relevant market for construction , services , <br /> supplies and equipment. <br /> 12 . 06 SMALL BUSINESS UTILIZATION <br /> ' A. In accordance with Section 129 of Public Law 100-590 , the Small Business <br /> Administration Reauthorization and Amendment Act of 1988 , the apparent Successful <br /> ' Bidder agrees to utilize , and to encourage its subcontractors under this Agreement to <br /> utilize , small businesses located in rural areas to the maximum extent possible . The <br /> apparent Successful Bidder shall follow the six affirmative steps stated in 40 CFR <br /> 30 .44 (b) , 31 . 36 or 35 . 6580 , as appropriate , in the award of any subcontracts under this <br /> Agreement . <br /> ' ARTICLE 13 - PREPARATION OF BID <br /> 13 . 01 The Bid form is included with the Bidding Documents . Additional copies may be obtained <br /> from the Issuing Office . <br /> ' 13 . 02 All blanks on the Bid form shall be completed by printing in ink or by typewriter and the <br /> Bid signed . A Bid price shall be indicated for each section , Bid item , alternative , adjustment unit <br /> price item , and unit price item listed therein , or the words " No Bid , " " No Change , " <br /> or " Not <br /> Applicable" entered . <br /> ' 13 . 03 A Bid by a corporation shall be executed in the corporate name by the president or a vice- <br /> president or other corporate officer accompanied by evidence of authority to sign . The corporate <br /> ' seal shall be affixed and attested by the secretary or an assistant secretary.
