08 - � � <br /> SECOND AMENDMENT TO <br /> WETLANDS MAINTENANCE SERVICES AGREEMENT <br /> This SECOND AMENDMENT WETLANDS MAINTENANCE SERVICES AGREEMENT <br /> ( "Second Amendment") is entered into as of this 20TH day of May 2008 (" Effective Date") , by and <br /> between Indian River County , a political subdivision of the State of Florida (" County") and Ecotech <br /> Consultants , Inc . (" Consultant") . <br /> BACKGROUND RECITALS <br /> A. Effective May 5 , 2005 , the County and the Consultant entered into the Wetlands Maintenance <br /> Services Agreement ("Agreement') for the provision of wetlands maintenance services as set forth <br /> therein . Effective February 19 , 2008 , the Agreement was amended to request that the Consultant <br /> perform additional services under the Agreement , and extended though April 30 , 2009 , in <br /> accordance with its terms , by the Amendment and Extension to Wetlands Maintenance Services <br /> Agreement (" First Amendment') . <br /> B . Pursuant to the Agreement , the County may request that the Consultant perform additional <br /> services thereunder. <br /> NOW THEREFORE , for good and valuable consideration , the receipt and sufficiency of <br /> which is hereby acknowledged , the parties agree as follows : <br /> 1 . The background recitals are true and correct , and form a material part of this Agreement . <br /> 2 . From and after the Effective Date of this Second Amendment , paragraph 3 of the Agreement is <br /> amended to include the Services as more specifically set forth in Exhibit 1 , for the price set forth in <br /> Exhibit 1 . <br /> 3 . From and after the Effective Date of this Second Amendment , all references to the "Agreement' <br /> shall be deemed to reference the Agreement as amended by the First Amendment and the Second <br /> Amendment . <br /> 4 .
