Shermatr N. Smith, Jr. stated there -were a number of population Acts <br />which should be repealed. Motion was made by Commissioner Macdonald, <br />seconded by Commissioner Waddell and unanimously passed, authorizing the <br />Attorney to draw up the necessary act to repeal same, sofar as Indian <br />River C.unty is concerned. <br />M Smith stated that he had been contacted by the Florida Inland <br />Navigation District and they would like a Resolution passed by this Board <br />regardi g spoil areas, etc. Motion was made by Commissioner Waddell, <br />seconded by Commissioner McCullers and unanimously carried, and the following <br />Resolution was adopted: <br />RESOLUTION NO. 61-7 <br />WHEREAS, one of the lawful and authorized purposes and func- <br />tions of the Board of County Commissioners of Indian River County, Florida, <br />is the establishment and maintenance of public parks for the use and benefit <br />of the general public; and, <br />WHEREAS, this County has heretofore established such public <br />parks but does not have such a public park bordering upon or in the Indian <br />River; and, <br />WHEREAS, the State of Florida, acting by and through the Trus - <br />tees of the Internal Improvement Fund is the owner of a parcel of property <br />hereinafter described located upon ;an island in the Indian River vhti ich is <br />accessible from the bridge across the Indian River known as State Road 510 <br />and which island has the possibilities upon development of an attractive site <br />a,s a public park permitting access by the general public to and from the Indian <br />River with boating and fishing, as well as the usual and normal attributes for <br />a public park; and, <br />WHEREAS, an easement was granted from the Trustees of the <br />Internal Improvement Fund of the State of Florida to the United States of <br />America, dated December 16, 1941, recorded in Deed Book 32, page 584, for <br />maintenance purposes and the perpetual right and easement to deposit spoil <br />dredged from the intracoastal waterway, which said easement was obtained by <br />and administered for the benefit of the Florida Inland Navigation District <br />known as MSA IR -3 and Mich exists upon a part of the lands hereinafter des- <br />cribed; <br />es-cribed; and, <br />
