,r <br /> co/ f' <br /> w <br /> FOURTH AMENDMENT TO <br /> INDIAN RIVER COUNTY EMERGENCY CONTRACT <br /> [Sheriffs Office 911 Center — Additional Repairs] <br /> [Barth Construction , Inc . ] <br /> THIS FOURTH AMENDMENT to Indian River County Emergency Contract ( " Fourth <br /> Amendment" ) is made and entered this 6th day of December, 2005 , nunc pro tunc to March 1 , <br /> 2005 , by and between INDIAN RIVER COUNTY , a political subdivision of the State of Florida <br /> ("County" ) and BARTH CONSTRUCTION , INC . , 1717 Indian River Blvd . , Suite 202A , Vero <br /> Beach , FL 32960 ("Contractor" ) . <br /> BACKGROUND RECITALS : <br /> A . The County and the Contractor have entered into an Emergency Contract for Repairs to <br /> an existing facility at the Sheriff' s Office Complex dated September 28 , 2004 (the "Agreement" ) <br /> for the repair and construction of certain emergency projects at the Sheriff' s Office Complex . <br /> B . Pursuant to Paragraphs 2 . 1 and 14 of the Agreement , the County and Contractor desire <br /> to amend the Agreement to include the additional emergency work at 'the Sheriff' s Office <br /> Complex as more fully set forth on Exhibit "A" attached hereto and made a part hereof. <br /> NOW, THEREFORE , for good and valuable consideration , the receipt and sufficiency of <br /> which are hereby acknowledged , and intended to be legally bound , the parties hereto agree as <br /> follows : <br /> 1 . The Agreement is hereby amended to allow for the additional services by Contractor at the <br /> Sheriffs Office Complex on the specifications and at the price more specifically set forth on <br /> Exhibit "A . " <br /> 2 . All remaining terms and conditions of the Agreement not changed by this Fourth <br /> Amendment remain in full force and effect . <br /> 3 . The Background Recitals are true and correct and form a material part of the Agreement , <br /> as supplemented by this Fourth Amendment . <br /> IN WITNESS WHEREOF , the parties have executed this Fourth Amendment as of the <br /> day and year first written above . <br /> BARTH ONS RUCTION , INC .
