ARTICLE 16 <br /> HOURS <br /> 16 . 01 A schedule of 24 hours on-duty and 48 hours off-duty will be applied . Hours <br /> worked over 40 hours per week will be paid at time-and -a-half. Hours paid <br /> but not worked shall not be regarded as time worked for the purpose of <br /> calculating overtime . <br /> 16 . 02 Sick leave shall be regarded as time worked for the purpose of calculating <br /> scheduled FLSA overtime . Should employees covered by this Agreement <br /> become legally eligible for the FLSA 7(k) exemption , said employees shall be <br /> paid overtime in the same manner as the County's other 7 (k) employees . <br /> The Union shall have the right to negotiate the impacts of such changes . <br /> 16 . 03 The parties recognize that the employees covered by this agreement are <br /> essential to the successful operations of County facilities and services during <br /> a declared emergency. As such , the parties agree that as a condition of <br /> these employees' employment with Indian River County, they must be <br /> available and able to report to work and perform assigned duties as directed <br /> by management during a declared emergency . The failure to report to work <br /> and/or perform assigned duties as directed by management during a <br /> declared emergency will be cause for termination of employment with Indian <br /> River County. The Emergency Services Director or his designee may allow <br /> 32 <br />
