1 <br /> iii . full access including right and left turn lanes but without signalization at <br /> lWh Avenue . <br /> c . pay the costs of signalization for 104th And 108th Avenues as specified in <br /> paragraph 3 , provide Fellsmere 392 with a full accounting of costs, and accept <br /> the contribution by Fellsmere 392 for 108th Avenue signalization and the <br /> contribution by Fellsmere 392 for 104th Avenue signalization . <br /> d . provide an access easement or other similar legal instrument immediately <br /> adjacent to the boundary of the Fellsmere 392 property where it abuts the CR- <br /> 512 right-of-way to extend 104th Avenue north of CR- 512 to allow access to <br /> the County CR- 512 stormwater pond . The County agrees to allow Fellsmere <br /> 392, its successors or assigns to create driveway connections to the extension <br /> and to utilize the extension of 104`h Avenue for all lawful purposes ordinarily <br /> allowed for a roadway (public or private) controlled by a governmental entity. <br /> e . accept from Fellsmere 392 the dedication of a perpetual non-exclusive access <br /> easement to the stormwater tract for CR-512 . Nothing herein shall be <br /> construed to prevent Fellsmere 392 , its successors or assigns from utilizing <br /> the area of the non-exclusive easement or driveways or other uses so long as <br /> they will not interfere with the County ' s perpetual , non-exclusive right of <br /> access , <br /> f. to immediately, upon execution of this agreement by all parties, commence <br /> design and permitting for the construction of access improvements on CR- 512 <br /> as described above and to complete the improvements within Five Hundred <br /> and Forty (540) days from the date the agreement is fully executed . <br /> Page 6 of 10 <br />
