ARTICLE 23 <br /> PERSONNEL REDUCTION <br /> 23 .01 If a personnel reduction is necessary, the Employer shall determine the number of employees <br /> and jobs affected in the bargaining unit and retain employees on the basis of job <br /> qualifications, job seniority, job performance and length of uninterrupted services as a full- <br /> time employee. Other factors being equal in the Fire Chief s judgment, seniority, as defined <br /> above, shall prevail. Laid-off employees shall be given preference before new employees are <br /> hired for future vacancies in the Fire Department, however, the laid-off employee must meet <br /> the basic qualifications for the job vacancy in the judgment of the Fire Chief, and be recalled <br /> within two (2) years of the employee's lay-off date. <br /> 23 .02 Laid-off employees shall retain seniority in the Fire Department for a period of two (2) years <br /> after lay-off. If a lay-off goes beyond one ( 1 ) year, the Employer will be obligated to <br /> recertify the employee with the State Minimum Standard Course with no cost to the <br /> employee . <br /> 23 .03 An employee shall lose seniority if the employee voluntarily quits or is discharged for cause, <br /> immediately upon the employee's last day in a work status. An employee shall be considered <br /> a voluntary quit if the employee is absent three (3) consecutive duty shifts without prior <br /> approval from, or notification to, the Fire Chief or his or her designated representative. <br /> 36 <br />
