ARTICLE 26 <br />MEDICAL LEAVE AND DISABILITY LEAVE <br />26.01 ELIGIBILITY <br />A. Full-time permanent non -shift employees earn medical leave at the rate of <br />one (1) work day per month starting the first full month of employment. Shift <br />employees shall accrue medical leave at the rate of one day (12 hours) per <br />month. For purposes of computation, one full 24-hour shift will be equal to <br />two (2) 12 -hour medical leave days. <br />B. Medical leave may be taken as earned during the employee's probationary <br />period. <br />C. Frequent claiming of benefits under this rule will constitute grounds for the <br />assumption by the Fire Chief that the physical condition of the employee is <br />below the standard necessary for the proper performance of duties. Likewise, <br />evidence of malingering or the abuse of this benefit will constitute grounds <br />for prompt dismissal or disciplinary action by the Fire Chief. Employees <br />suspected of abusing leave will be placed on notice and will be required to <br />submit a doctor's note upon their return to work. Abuse of leave shall be <br />defined as three occurrences in a 90 day period. <br />26.02 EARNING OF MEDICAL LEAVE <br />An employee on medical leave for more than fifteen (15) consecutive working days shall not <br />accrue medical leave for that period of time. <br />26.03 ADDITIONAL MEDICAL LEAVE <br />In deserving cases additional medical leave may be granted with the Director of Emergency <br />Services approval. <br />39 <br />
