C . This liquidated damage clause shall be applied , if necessary , through the implementation phases , execution phases , and operations phases of this Contract . Article 39 . Contractor' s Representations - In order to induce County to enter into this Contract , Contractor makes the following representations : A . Contractor has familiarized himself with the nature and extent of his obligations under this Contract . Contractor has familiarized himself with the work site , locality , and all local conditions and laws and regulations that in any manner may affect his costs , progress , or performance . B . Contractor has carefully studied , or will carefully study , all reports of explorations and tests of conditions provided or not provided in this Contract prior to any work and accepts , or shall accept , the accuracy of any technical data contained in such reports and conditions , upon which Contractor is entitled to rely . C . Contractor has obtained and carefully studied , or assumes responsibility for obtaining and carefully studying , all such observations , examinations , investigations , explorations , tests , reports , and studies ( in addition to those referred to in Subarticle B . above ) pertaining to the conditions or otherwise affecting his performance as Contractor considers necessary for the performance at Contract Price and in accordance with the other terms and conditions of this Contract . D . At the time of entering into this Contract , Contractor has given County ' s designated representative written notice of all conflicts , errors , and discrepancies that Contractor had discovered in Contract Documents , and the written resolution thereof by County is acceptable to Contractor. Article 40 . Notice — A . Any notice , request , instruction , demand , consent , or other communication required or permitted to be given under this Contract shall be : ( 1 ) in writing ; ( 2 ) delivered ( to the addresses listed in this Article 41 below , or such other address as the parties may provide to each other in writing ) by one of the following means : ( a ) by hand ; ( b ) by overnight mail service ( such as Federal Express ) ; or ( c ) by certified mail , postage prepaid , and certified return receipt requested to the following address , or such other address as the parties may provide to each other in writing : To : SunGard Business Systems Inc . , With a copy to : [ Name of Division ] Mailing Services Division Attn : Joe M .
