20. PROTECTION OF WORK <br /> Property. The CONTRACTOR shall, at its own expense, support and protect all public or <br /> private property that may be endangered in the execution of the work described for this <br /> project. The CONTRACTOR shall repair to its original condition and make good any <br /> damage caused to any such property by reason of its operation. <br /> Risk of Loss. All construction and associated activities specified in the Technical <br /> Specifications and Plans for this project shall be performed at the sole risk and cost of the <br /> CONTRACTOR from commencement until final payment by the COUNTY. Any specific <br /> references contained in the Contract Documents, including the Specifications, that the <br /> CONTRACTOR shall be responsible at its sole risk and cost for the work or any part <br /> thereof are not intended to be, nor shall they be construed to be, an exclusive listing of the <br /> circumstances in which the CONTRACTOR bears the risk of loss, but rather they are <br /> intended only to be exemplary. <br /> All loss or damage caused by the nature of the work or work environment, acts of nature <br /> such as storms, unusual obstructions to the work, or any other natural or existing <br /> circumstances either known or unforeseen that may be encountered in the conduct of the <br /> work, shall be sustained and borne by the CONTRACTOR at its own cost and expense. <br /> The CONTRACTOR shall have no claim against the COUNTY because of any damage or <br /> loss to the work or CONTRACTOR's materials, equipment or supplies, including no claim <br /> for loss or damage due to simultaneous work by others, and the CONTRACTOR shall be <br /> responsible for the complete restoration of damaged work to its original condition <br /> complying with the Contract Documents. Notwithstanding any other provision of this <br /> Contract, this obligation shall exist without regard to the availability of any insurance, <br /> either of the COUNTY or the CONTRACTOR, to indemnify, hold harmless or reimburse <br /> the CONTRACTOR for the cost incurred in making such restoration. <br /> 21 . NOTICE TO MARINERS <br /> Prior to construction, the CONTRACTOR is required to provide a Notice to Mariners describing the <br /> construction operations and work areas . Should the CONTRACTOR encounter any unmarked <br /> hazards to navigation floating or on the ocean floor, it is the responsibility of the CONTRACTOR to <br /> provide a Notice to Mariners and to immediately notify the COUNTY. The CONTRACTOR shall <br /> provide to the COUNTY an original proof of publication for any Notice to Mariners. <br /> TECHNICAL AND ENVIRONMENTAL SPECIFICATIONS _ TS-22 <br />
