RESOLUTION '+ <br />4616 16 <br />WHEREAS, Indian River County, Florida, filed on June 6, 1958, <br />application No. BLit 046981, with the Bureau of Land Management, <br />U. S. Department of the Interior, to purchase certain described <br />rublic land within the State of Florida under provisions of the <br />Recreation and Public Purposes Act of June 14, 1926 (44 Stat.741), <br />as amended for development and use for recreation and other public <br />purposes and, <br />WHEREAS, the regulations of the Department of the Interior, <br />governing procedures under the Act, supra, and supplemental instruc- <br />tions of the Director of the Bureau of Land Management require, in <br />consideration of the reduced purchase price to be set because of <br />the proposed public use of the land, certain assurances that the <br />purpose and intent of the Act will be fulfilled following; passage <br />of title of the lands to the State, NOW, THEREFORE, <br />BE IT RESOLVED by the Board of County Commissioners of Indian <br />River County, Florida, that Indian River County, Florida, does hereby <br />obligate itself to the following commitments and consent to the in- <br />corporation of these commitments, by reference or otherwise, in the <br />patent or patents issued to the County pursuant to the above identi- <br />fied application: <br />A. To maintain the lands open to use by the public for <br />recreation purposes without discrimination or favor. <br />B. To make no more than a reasonable charge for the use of <br />facilities on the land (whether by concession or other- <br />wise) and to charge no more for entrance to and use of <br />the area than is charged at other comparable installa- <br />tions managed by State and local agencies, all charges <br />to be subject to review and modification by the Secre- <br />tary of the Interior, under due process procedures. <br />C. To develop and manage the lands in accordance with an <br />approved program of utilization, which program must <br />include a statement of need and a statement of purposes <br />and objectives and must contain a plan of development, <br />plan of operation, and time schedules in sufficient <br />detail to permit effective enforcement by enabling <br />clear showings of nonperformance if necessary.. <br />D. To allow the Bureau of Land Management, U. S. Depart - <br />went of the Interior, to manage, consistent with the <br />recreational objectives of the area, all other values <br />of the lands and to recognize the right of the United. <br />States to retain the revenues from such management. <br />BE IT FURTHER RESOLVED that Indian River County, Florida, does <br />hereby consent to the inclusion in the patent or patents of a restric- <br />'tion that no building will or may be constructed on such land which <br />is more than 38 feet above mean sea level. <br />
