030090 <br /> AGREEMENT BETWEEN <br /> INDIAN RIVER COUNTY, FLORIDA <br /> AND <br /> GRAND HARBOR <br /> RELATING TO THE EXCHANGE OF REAL PROPERTY <br /> THIS IS AN AGREEMENT RELATING TO THE EXCHANGE OF REAL <br /> PROPERTY (this "Agreement") , between INDIAN RIVER COUNTY, FLORIDA, a <br /> political subdivision of the State of Florida, whose mailing address is 1840 25th Street, Vero <br /> Beach, Florida, 32960 ("County") and GHA GRAND HARBOR, LTD , a Florida limited <br /> partnership , whose mailing address is 2121 Grand Harbor Boulevard, Vero Beach, FL 32967 <br /> ("Grand Harbor") . <br /> WITNESSETH <br /> WHEREAS , Grand Harbor is the owner and developer of real property located within <br /> the Grand Harbor Development of Regional Impact (DRI) , Indian River County, Florida as more <br /> particularly described in Exhibit "A" ; and <br /> WHEREAS , Grand Harbor has acquired a parcel of property adjacent to the Grand <br /> Harbor DRI commonly referred to as the "Luther Parcel" as more particularly described in <br /> Exhibit "B " ; and to amend the Grand Harbor DRI to include the Luther Parcel ; and <br /> WHEREAS , the portion of the public right-of-way for 53rd Street which is owned by the <br /> County and is more particularly described in Exhibit " C " , ( " County Right- of-Way") lies between <br /> the Luther Parcel and the Grand Harbor DRI as depicted on the sketch attached as Exhibit "D " ; <br /> and <br /> \\ftl-srv01\DARELLIP\401987v l2\8 m6b 12 ! .DOC\3/13/03\24380.010100 <br /> 1 <br />
