G. The table below identifies the finding supporting this Agreement and EPA Grants providing the funds. <br />EPA Grant Number <br />CFDA <br />Pro ram Tide <br />Funding Amount <br />C9-99451505-0 <br />66.460 <br />Nonpoint Source Implementation Grants <br />$725,500.00 <br />Total Funding: <br />$725,500.00 <br />4. The State of Florida's performance and obligation to pay under this Agreement is contingent upon an annual <br />appropriation by the Legislature. The parties hereto understand that this Agreement is not a commitment of fimtre <br />appropriations. <br />5. A. The Grantee shall submit progress reports in accordance with the schedule contained in Attachment A. <br />Progress reports shall be submitted in conjunction with the Payment Request Summary Form, described in <br />paragraph 3.B. Progress reports shall describe the work performed, problems encountered, problem <br />resolution, schedule updates and proposed work for the next reporting period. The Grantee shall utilize <br />the Attachment D, Progress Reporting Form, for submitting its progress report. Reports shall be <br />submitted to the Department's Grant Manager no later than twenty (20) days following the completion of <br />the reporting period. The final report shall be submitted no later than thirty (30) days prior to the <br />completion date of the Agreement. The Department's Grant Manager shall have ten (10) calendar days to <br />review deliverables submitted by the Grantee. Final payment, no less than ten (10) percent of the total <br />Agreement amount identified in paragraph 3.A., will be withheld until receipt and approval of the Final <br />Report. <br />B. The Grantee agrees to comply with the requirements of EPA's Program for Utilization of Small, Minority, <br />and Women's Business Enterprises in procurement under this Agreement. <br />The Grantee <br />accepts the <br />Minority Business Enterprise/Women's Business <br />Enterprise <br />(MBE/WBE) "Fair <br />Share" goals <br />and objectives negotiated with EPA as follows: <br />in conjunction with <br />If the Grantee does not want to rely on the applicable State's MBE/WBE goals, the Grantee <br />agrees to submit proposed MBF,./WBE goals based on availability of qualified minority and <br />women -owned business to do work in the relevant market for construction, services, supplies and <br />equipment. "Fair Share" objectives must be submitted to the EPA Grants Management Office, <br />61 Forsyth Street, Atlanta, GA 30303 within thirty (30) calendar days of award and approved by <br />EPA no later than thirty (30) calendar days thereafter. Copies of all correspondence with EPA <br />shall also be forwarded to the Department's Grant Manager. <br />3. The Grantee agrees to ensure, to the fullest extent possible, that at least the applicable "Fair <br />Share" objectives of Federal funds for prime contracts or subcontracts for supplies, construction, <br />equipment or services are made available to organizations owned or controlled by socially and <br />economically disadvantaged individuals, women and Historically Black Colleges and <br />Universities. <br />4. The Grantee agrees to include in its bid documents the applicable "Fair Share" objectives and <br />require all of its prime contractors to include in their bid documents for subcontracts the <br />negotiated "Fair Share" percentages. <br />5. The Grantee agrees to follow the six affirmative steps or positive efforts stated in 40 C.F.R. <br />30.44(b), 40 C.F.R. 31.36(e), or 40 C.F.R. 35.6580, as appropriate, and retain records <br />documenting compliance. <br />6.
