<br /> GRANT OF EASEMENT /
<br /> THIS INDENTURE, made and entered into on this day of
<br /> 2007 , by and between INDIAN RIVER COUNTY, a political subdivision of the State of Florida,
<br /> whose post office address is 1801 27th Street, Vero Beach FL 32960, " Grantor," and INDIAN
<br /> RIVER FARMS WATER CONTROL DISTRICT, formerly known as INDIAN RIVER
<br /> FARMS DRAINAGE DISTRICT, a water control district existing under Chapter 298 , Florida
<br /> Statutes, whose post office address is 7305 4th Street, Vero Beach, FL 32968 , " Grantee" ;
<br /> (Wherever used herein, the terms "Grantor" and Grantee" include all the parties to
<br /> this instrument and the heirs, legal representatives and assigns of individuals, and the
<br /> successors and assigns of corporations.)
<br /> For the sum of S 10 .00 and other good and valuable considerations , the receipt and sufficiency
<br /> of which is hereby acknowledged, Grantor does give and grant to Grantee an easement and
<br /> right-of-way for purposes of construction, location, ingress, egress, canal maintenance, drainage, and
<br /> for all functions and purposes Grantee is authorized by law to perform, on, over and across the
<br /> following described property, situate, lying and being in Indian River County, Florida, to-wit:
<br /> A parcel of land being a portion of Tract 1 , Section 12, Township 33 South, Range 38 East,
<br /> Indian River Farms Company Subdivision, according to the plat thereof, as recorded in Plat
<br /> Book 2, Page 25 , of the Public Records of St. Lucie County, now Indian River County,
<br /> Florida. Said parcel being more particularly described as follows :
<br /> The South 12.00 feet of the North 42. 00 feet of the East 90. 00 feet of said Section 12 .
<br /> Together with all of Tract R-3 as shown on the plat of Pointe West Central Village, Phase
<br /> V, PD , recorded in Plat Book 21 , Pages 48-51 , Public Records of Indian River County,
<br /> Florida. As set forth on Exhibit "A" attached hereto.
<br /> TO HAVE AND TO HOLD the same together with all and singular the appurtenances
<br /> thereunto , for the use, benefit and profit of the said Grantee, its successors and assigns.
